3 DETENTION Detention, or detaining, is holding a person in order to ask questions or investigate an incident etc. It may or may not lead to an arrest or charge. 4 Detention A person being detained has the right to be informed of the detention and why and has the right to legal counsel. If a person refuses to cooperate with a detention, then an officer may have the authority to arrest the person. Arrest or detention can not be arbitrary. An officer MUST have reasonable grounds.

5 Reasonable grounds Reasonable grounds means that based on the information that the officer has available, it is reasonable to believe that the suspect has committed or about to commit a criminal offence.

6 Arrest-what is it? One method of compelling a person to face a charge(s). Last course of action to do so. Where possible other methods must be used. May only be temporary! WHY?....

7 Temporary Arrest Mostly for Summary offences to positively identify a person. obtain or secure evidence. to complete a search. prevent a crime from continuing (ie. Assault, drinking and driving, mischief). Once these things have been done/satisfied, then the person must be released.
