NO Temporary Restraining Order (TRO); NO Writ of Preliminary Injunction; and NO Question on the Constitutionality of ANY of its Provisions or of its Implementing Rules & Regulations (IRR) Note: Sec. 302 of P.D. 5 PRBoA Secs 302.3 & 4 of the 2004 Revised IRR of P.D. No. 1096 (1977 NBCP) are in full effect! These limit the signing and sealing of architectural plans only to registered & licensed architects (RLAs). NO Temporary Restraining Order (TRO); NO Writ of Preliminary Injunction (The May 2005 Injunction secured by the PICE was lifted/ dissolved in Jan 2009). PRBoA Secs 302.3 & 4 of the 2004 Revised IRR of P.D. No. 1096 (1977 NBCP) are in full effect! No. 9266’s Regulation Stream IRR in full effect since 01 Dec 2004; and Code of Ethics in effect since 2006 1979 Standards of Practice about 10% revised; need to fast-track this effort; Some Guidelines & derivative regulations already issued by the PRBoA & PRC; & Manual of Procedure (MoP)* for crafting. * Note: The MoP shall give direct instructions to RLAs as to how to react when confronted with certain practice situations or conditions. The MoP shall be based on the collective experiences and actions of RLAs to guide other RLAs. PRBoA R.A. 9 PRBoA Fast Facts on Aspirants & Practitioners: 1) over the 9-year period 1998 through 2006, there were 19,060 graduates of the B.S. Arch. program; 2) 32.19% (6,136) of the said graduates were female; 3) for the year 2007, the POEA reported that there were 420 architects or town planners who left for work overseas i.e. 28 countries; KSA(rabia) had the highest number of such OFWs with 173 (41.19%); 4) 9.05% (38) of the said professional OFWs were female; 5) for the year 2007, the POEA also reported that there were 965 draftsmen who left for work overseas i.e. 24 countries (but those headed for jobs requiring architectural skillsets were not identified); KSA had the highest number of such OFWs with 455 (47.15%); and 6) 8.39% (81) of the said sub-professional OFWs were female. 11 PRBoA 2-Year Due Process Flow of CRIMINAL Complaints for R.A. No. 9266 Violations: 1) Criminal Complaint filed at the PRC; 2) PRBoA establishes prima facie finding; 3) Complaint Endorsed to DoJ Secretary; 4) after review, DoJ Secretary endorses to either the NBI or Local Prosecutor/ Fiscal; 5) Local Fiscal investigates and either files information with the Court (if there is probable cause) or reverse-endorses the complaint to either the DoJ Secretary or the PRC/ PRBoA (in case of no finding of probable cause) i.e. NO CASE FILED AFTER 2 YRS PRBoA 2-Year Due Process Flow of CRIMINAL Complaints for R.A. No. 9266 e.g. addressing the continuing illegal practices by firms and individuals, acts by other state-regulated professions to co-opt the practice of architecture, etc.; 2) formalization of the integration of the profession, the IAPOA structure/ organization and its relationship with the other architectural organizations; 3) the Standards of Professional Practice; 4) the GATS, APEC Architect Registry and ASEAN MRA; 5) the CPE/ CPD program; 6) laws directly affecting the practice (P.D. No. 1096, R.A. No. 9514, B.P. No. 344, P.D. No. 957, B.P. No. 220, R.A. No. 9184, R.A. No. 7160, etc.) and their IRRs/ derivative regulations; 7) the B.S. Architecture curriculum; 8) relations with the allied professions; 9) media campaign for the architectural profession; and 10) new appointments to the PRBoA.
