2 The rule: Must meet the statutory definition of elementary and secondary schools found in the No Child Left Behind Act of 2001 (20 U.S.C. § 7801 (18) and (38)) Non-profit & traditional – Elementary – Secondary – Educational Service Agency (or County Office of Education) – Charter schools, public and private – Religious schools, public and private Eligible Entities - Schools E-rate Modernization 2015 2

3 In the State of California, the following non- traditional facilities and students also qualify: – Pre-K – Head Start – Juvenile Justice – Adult Ed – must not include education beyond grade 12 – Educational Service Agency (or County Office of Education) Schools operating as for-profit or that have endowments exceeding $50 million are not eligible. 4 School Residential Facilities: beginning with Funding Year 2011: School on Tribal lands Schools that serve children with physical, cognitive and behavioral disabilities Schools that serve children with medical needs Juvenile justice schools Schools with 35% or more students eligible for the National School Lunch Program Eligible Entities - Schools E-rate Modernization 2015 4

6 The rule: Libraries must meet the statutory definition of library or library consortium found in the 1996 Library Services and Technology Act (Pub. L. 104- 208) (LSTA) and must be eligible for assistance from a state library administrative agency under that Act. Non-profit & traditional Eligible Entities - Libraries E-rate Modernization 2015 6

9 Discounts range from 20 to 90 percent of the cost of eligible services. – Based on the percent of students that qualify for the NSLP program and Urban/Rural status Discount Calculations E-rate Modernization 2015 9

10 Details – NSLP eligibility Calculated for the organization as a whole Libraries – use NSLP eligibility of district where main branch is located Consortia – continue to use simple average of members – Urban/Rural status Determined by the majority of sites in the organization – Must have more than 50% of sites classified as Rural for the organization to be determined to be a Rural District/Library Discount Calculations E-rate Modernization 2015 10

12 Recommended method – Use the CalPads 1.17 report for the October 2015 reporting period Report can be obtained from the designated CalPads Coordinator Most efficient method for the application review process – Completed report should be available from CalPads Coordinator no later than December 19, 2015. 14 Community Eligibility Program (CEP) – At least 40% of students are directly certified – Allows all student to eat free, but does not mean they are all counted as eligible for E-rate purposes. – Eligibility determined by the Identified Student Percentage (ISP) Multiply the ISP by the national multiplier (1.6) to determine NSLP eligibility for E-rate Discount Calculations E-rate Modernization 2015 14

15 Provisions 1, 2 and 3 – Allow for socio-economic survey to be used to establish reimbursement rate and reduce paperwork for schools – Applicant uses approved NSLP eligibility percentage to calculate discount rate – Schools submit base-year documentation to support discount rate – If extension is granted, applicants can submit extension approval letter to support discount rate Discount Calculations E-rate Modernization 2015 15

16 Head Start – All students qualify for NSLP program – However, Early Head Start (EHS) students do not qualify for E-rate program If facility is shared with Head Start students and Early Head Start students a cost allocation must be done to account for the ineligible students.
