2 Penalty for Copyright Infringement: "Federal law provides severe civil and criminal penalties for the unauthorized reproduction, distribution, or exhibition of copyrighted materials. Criminal copyright infringement is investigated by the FBI.” - Title 17 of the United States Code

3 The “fair use” clause -A limitation and exception to the exclusive right granted by copyright law to the author of a creative work, is a doctrine in United States copyright law that allows limited use of copyrighted material without acquiring permission from the rights holders. - Examples of fair use include commentary, criticism, news reporting, research, teaching, library archiving and scholarship. -Everyone is included in the fair use clause

4 Decisions for deciding “fair use” Notwithstanding the provisions of section 106, the fair use of a copyrighted work, including such use by reproduction in copies or phone records or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use, the factors to be considered shall include: 1.The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; 2.the nature of the copyrighted work; 3.the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and 4.the effect of the use upon the potential market for or value of the copyrighted work

5 When using multimedia in the classroom: Using only original material Use materials that have been confirmed to be used in a public domain Always get permission when is is necessary

6 The conditions for using someone else’s words, music, and/or film: Always get permission to use some one else’s work Cite what you are using and give them full credit Do not change their original work or try to improve on it to make it your own

7 Using recorded TV in the classroom: 1. The film must be shown as part of the instructional program. 2. The film must be shown by students, instructors, or guest lecturers, and can only be shown to students and educators. 3. The film must be shown either in a classroom or other school location devoted to instruction. 4. The film must be shown either in a face‐to‐face setting or where students and teacher(s) are in the same building or general area. 5. The film shown must be a legitimate copy, with the copyright notice included. 6. Films or videos may not be used for entertainment or recreation

8 Getting permission to use items in your classroom: Use your best jugdement on what the item may be for use in your classroom Get permission by the principle Get permission by the person to whom the item originally belongs

9 When a creator posts items to a website: Unless the work is copyrighted the work may be copied and used by others Put your “terms of use” if any to the website to avoid plagiarists Always be careful of what you post and use your best judgement
