6 TITLE 38 CHAPTER 42. EMPLOYMENT AND TRAINING OF VETERANS § 4211. Definitions

7 1) The term "special disabled veteran" means — (A) a veteran who is entitled to compensation (or who but for the receipt of military retired pay would be entitled to compensation) under laws administered by the Secretary for a disability (i) rated at 30 percent or more, or (ii) rated at 10 or 20 percent in the case of a veteran who has been determined under section 3106 of this title to have a serious employment handicap; or (B) a person who was discharged or released from active duty because of service-connected disability.

8 2) The term "veteran of the Vietnam era" means an eligible veteran any part of whose active military, naval, or air service was during the Vietnam era. 3) The term "disabled veteran" means (A) a veteran who is entitled to compensation (or who but for the receipt of military retired pay would be entitled to compensation) under laws administered by the Secretary, or (B) a person who was discharged or released from active duty because of a service- connected disability.

9 4)The term "eligible veteran" means a person who — (A) served on active duty for a period of more than 180 days and was discharged or released there from with other than a dishonorable discharge; (B) was discharged or released from active duty because of a service-connected disability; or as a member of a reserve component under an order to active duty pursuant to section 12301(a), (d), or (g), 12302, or 12304 of title 10, served on active duty during a period of war or in a campaign or expedition for which a campaign badge is authorized and was discharged or released from such duty with other than a dishonorable discharge.

10 5)-Eligible Person- Means the spouse of any of the following: 1)- Any veteran that died of a service connected disability; 2)- Any member of the armed forces service on active duty who, at the time of application for the priority, is listed as one or more of the following categories and has been so listed a total of more than 90 days: Missing In Action, Captured in line of duty by a hostile force, forcibly detained or interned in the line of duty by a foreign government. 3)- Any veterans who has a total disability resulting from a service connected disability, as evaluated by the V.A. 4)- Any veteran who died of a disability as indicated in number 3 above.

11 DVOP and LVERs

12 DVOP (Disabled Veterans Outreach Program) DVOP specialist provide intensive services to meet the employment needs of special disabled veterans, disabled veterans, veterans and eligible persons. DVOP specialist are actively involved in outreach efforts to increase program participation among those with the greatest barriers to employment.

13 Intensive Services provided by DVOP specialists Conduct an assessment Develop employment plans Provide career guidance Refer and coordinate supportive services Make Job Development contacts Provide referrals to training Referrals to job openings

14 LVER (Local Veterans Employment Representative) LVER staff conduct outreach to employers and engage in advocacy efforts with hiring executives to increase employment opportunities for veterans, encourage the hiring of disabled veterans and generally assist veterans to gain and retain employment. LVER staff conduct seminars for employers and job search workshops for veterans seeking employment, and facilitate priority of service in regard to employment, training, and placement services furnished to veterans by all staff of the employment service offices.

29 Example 2 Priority of Service is the right of a veteran or eligible spouse of a veteran to be given priority of service over a non-covered person for the receipt of employment, training and placement services not withstanding other provisions of the law. Links to DES Forms

31 Percentage Served Example: – You served 100 Non Veterans and gave 50 of them job referrals. – You served 10 Veterans and gave 6 of them job referrals. – You have now given 60% of the Veterans a job referral -vs- 50% of Non Veterans. – This is GOOD!

32 Date of Service Given Count of people who received services within 45 days of Registration – Covered Entrants – Unserved Covered Entrants (Means they did not get services with first 45 days) – Served Covered Persons The totals of Covered Entrants and Covered Persons should not be lower than the Unserved!
