1 Trans-boundary EIA in the Slovak Republic History 18 November 1999 Ratification of ESPOO Convention by the Slovak Republic 17 February 2000 ESPOO Convention entered into force in the Slovak Republic

2 Transboundary EIA in the Slovak Republic Status of legislation Act No. 127/1994 Col. on EIA as amended Transboundary EIA is described in the third part of the Act (Art. 25 – 34) and Annexes No. 5,6,7 to this Act It is fully harmonised with ESPOO Convention

3 Current status of the implementation The Slovak Republic is prepared to make bilateral agreements with all coterminous states Slovakia – Austria Slovakia - Hungary Slovakia – Czech Republic Slovakia – Poland Slovakia – Ukraine

4 Current status of the implementation Ministry of Environment is responsible for the implementation of Trans-boundary EIA – contact point for all assessed projects

5 Current status of the implementation Bilateral agreement with Austria - has already been elaborated, - agreed by both sides - prepared for negotiation of both governments and following ratification Expected to be in force in second half of 2004

6 Current status of the implementation 1. Bilateral agreement with Hungary – the proposal is prepared for legal departments of both sides to complete it 2 Bilateral agreements with the Czech Republic and Poland are under preparation and discussion

7 Current status of the implementation  The Slovak Republic in co-operation with the other coterminous states makes the notification about each project/activity which could cause the adverse impacts on the coterminous state  The assessment is done according to the ESPOO Convention and existing national legal instruments

8 Current status of the implementation Examples of notificated cases of trans-boundary EIA: Slovakia – Czech Republic - wind power stations, long distance gas lines Czech Republic – Slovakia – thermal power stations Slovakia - Austria – bridge over the river Morava, transfer station at the river Morava, pipeline, Energy policy of the SR (active participation of Austrian side at public hearing in Slovakia) Austria – Slovakia – highway Slovakia – Hungary – transfer station of mineral oils on Danube
