Kurtzman – what First Amendment clause is this based on?  What was the Supreme Courts decision?  a.) Engel v. Vitale – 1.) struck down state sponsored prayer in school. 2.) Court said that the prayer demonstrated the state officially backed religion.  b.) Lemon v. Kurtzman – 1.) Struck down state funding for private religious schools – struck down state funding paying parochial school teachers for teaching secular subjects. 2.) Three pronged lemon test.

3.  C.) Oregon v. Smith/Reynolds v. United States – Free Exercise Clause  D.) Reynolds v. United States – the decision restricted polygamy in the United States.  They would not accept unconstitutional – why?  It’s not a government action – a government action can be unconstitutional – this is a personal decision.  Oregon v.
