3 ELEMENTS OF A CRIME n A Duty to do (or not do) a certain thing. n An act or omission in violation of that duty n Criminal intent-intended to commit the act and intended to do evil. Concept-Vicarious liability-being responsible for others in the work place.

4 Felonies vs Misdemeanors n Felony-very serious crime punishable by confinement for more than one year in a state prison or by execution. n Misdemeanors-less serious crime punishable by confinement in a county or city jail for less than one year, by fine, or both.

5 Defenses to Criminal Charges n Procedural-based on procedure due to gathering of evidence n Substantive-disprove, justify, or excuse the alleged crime. Ignorance is not a defense.

6 Types of Substantive Defenses n Self Defense-Right to use reasonable force for protection. n Criminal Insanity-Cannot tell between right and wrong n Immunity-Freedom from prosecution even though a crime has been committed(plea bargain) Contempt of court-if you do not follow through with agreement.
