4 Florida Financial Responsibility Law  Trigger  An accident with involves “either”  Bodily injury  Property Damage when “A” vehicle is rendered inoperative  Certain serious traffic Violations  DUI  Felony

5 Florida Financial Responsibility Law  Requirement if Florida Financial Responsibility Law is Triggered then all must show  Liability insurance of 10/20/10 or Combined single Limit of $30,000  Proof of “self insurance”  Bond or cash was posted with the state of $30,000 BEFORE accident If financial responsibility is shown no criminal penalty If requirements are not available then:

6 Florida Financial Responsibility Law The parties must  Satisfy all legally valid claims up to 10/20/10*  Provide certification of Financial Responsibility for “Future” Accidents  Must file and SR22  If no auto must purchase Named Nonowner policy Satisfaction of 10/20/10 does not relieve civil responsibility

7 Florida Financial Responsibility Law  Penalty for non compliance  The drivers license of the operators will be suspended  ALL registrations in the name of that operator will be suspended.  The Florida Financial Responsibility Law is administered by the Department of Highway Safety and Motor Vehicles

8 The Personal Auto Policy Part A – Limits and how they work  Single Limits a/k/a Combines Single Limits CSL apply to all claims for BI and PD arising from a single accident  Split Limits, three limits apply one for each person injured in the accident another for ALL BI claims arising out of each accident and a limit for PD only!

9 The Personal Auto Policy Part A – Limits and how they work 100,000 limit for PD and only PD Problems available in workbook 100/300/100 100,000 a limit for one person in an accident 300,000 limit paid for BI in any one accident

10 The Personal Auto Policy Part A Note: The cost to defend is a supplementary payment and is OVER and above the liability limit Liability coverage is Primary in an Owned vehicle Excess in a Non owned vehicle There is no aggregate limit of protections, the full amounts of the limits are available for each accident

11 The Personal Auto Policy Part B – Medical Payments Coverage that pays expenses incurred for the necessary medical funeral services to persons injured by accidents. Payments are without regard or fault or legal liabilities. Pays for expenses incurred for services rendered within three years from the date of the accident

12 The Personal Auto Policy Part B – Medical Payments Coverage is for the named insured and family members for:  Injuries while occupying, or as a pedestrian if struck by ANY motor vehicle designed for the use mainly on public roads or any type of trailer equipment  Other persons while occupying “your covered auto”  Primary in an Owned vehicle Excess in a Non owned vehicle

13 The Personal Auto Policy Part C – Uninsured motorist Sometimes the most Misunderstood coverage! YOU FAULTNO YOUR Uninsured motorist aka “under”insured motorist pay YOU if you are injured by a motorist who is AT FAULT in the accident and has NO Liability coverage or limits lower than an amount to cover YOUR injuries NOTE! Uninsured motorist covers only Bodily Injury it does NOT cover Property Damage

14 MECHANICAL BREAKDOWN INSURANCE  Typically, the following parts are covered Engine – transmission -drive axle - steering assembly air conditioner - front suspension.  Payment is for the usual and fair charge for parts and labor to repair or replace a covered part with like kind and quality  A specific dollar limit of coverage may be specified with the company's responsibility limited to not more than the actual cash value of the vehicle.  Some policies have a rental reimbursement provision, paying up to $15 per day, up to a maximum of $75

15 MECHANICAL BREAKDOWN INSURANCE - EXCLUSIONS  Principal exclusions may include: Mechanical breakdown caused by lack of customary maintenance. Breakdown caused by collision, fire, theft, vandalism, riot, explosion, lightning, earthquake, Wind storm, hail or flood. If the odometer or any covered part has been altered in any way. Towing, road service or storage charges. Seals, gaskets, oil, grease or refrigerant unless required in connection with the repair of a covered part. Motor tune-ups. Breakdown resulting from racing or other competition. Breakdown caused by towing a trailer or another vehicle, unless the covered vehicle is equipped for this as recommended by the manufacturer. If the covered vehicle is used to carry passengers for hire or if it is rented to another.

16 MECHANICAL BREAKDOWN INSURANCE  Deductible Coverage is subject to a deductible which is subtracted from the cost incurred to remedy each breakdown per assembly. A single deductible applies if more than one covered part is involved in the same breakdown.  Territory The policy territory, within which the breakdown must occur during the policy period, is usually the United States, its territories or possessions, and Canada.  Policy Term NEW CARS generally the term is 36 months after delivery or 36,000 miles, whichever comes first, for new cars, USED CARS generally the term is and 12 months or 12,000 miles for used cars.
