3 © WHATS CHANGED IN THE NEW LICENCE ? No limit on number of copies that can be made for each separate occasion of copying, except Nothing in EU Directive affects the licence for NHS users Copying for a Designated Committee limited to maximum of 25 and one person must be NHS employee Journal Clubs, etc, can now make as many copies as they need Additional allowances for visually impaired, no copy limits, electronically manipulate etc

4 ©SCANNING NOW AVAILABLE Scanning permitted on same basis as photocopying, i.e. as many copies as required (except Desg. Cmtee). Digital Copies (DC) can be sent as an e-mail attachment to any ‘Authorised Person’ who has access to a secure NHS ‘Intranet’ which is protected by password. The DC be saved on a local hard drive or floppy disc by individual receiving, but not on a central server, and no systematic indexing (not yet !) other than for technical or ‘back-up’ purposes, or as required by law

5 Only UK publications can be scanned – other territories will be added later ( USA expected end of 2003) No editing or changes of any kind permitted DC cannot be placed on any internet web site or linked to or from any external or third party website Can be printed out, and copy used as original for photocopying DC can be forwarded to another authorised person ©SCANNING NOW AVAILABLE (continued)

6 DC can be given to a patient by any authorised person, but only as part of, and relevant to their treatment. Specific copies requested by patient are not allowed under the licence, but may be Fair Dealing etc. An original publication, or cleared through document delivery supplier, must be owned Material obtained in electronic form (Third Party Digital Material ), e.g document delivery, press cuttings agency, etc can be scanned or forwarded etc ©SCANNING NOW AVAILABLE (continued)

7 If the page contains any photograph, illustration etc, and the creator’s name or identity as apparent, this must be included in the DC. If DC is sent to a patient under the licence, a cover page indicating that it is a DC, made under the CLA licence, and may not be further copied or distributed must be attached. EC Directive; any copies made for internal use by NHS are covered under the CLA licence and do not require any other clearance. ©SCANNING NOW AVAILABLE (continued)

10 DEFINITIONS AND INTERPRETATION “Authorised Persons” (i) in respect of Paper Copies: employees of the Licensee, workers and consultants engaged by the Licensee; and any General Medical practitioner on the medical list of a Primary Care Trust or Island Health Board, any General Medical Practitioner who is contracted or employed to provide a service to the NHS in Scotland and any staff of such General Medical Practitioners. (ii) in respect of Digital Copies: all employees of the Licensee but only those workers and consultants engaged by the Licensee, and any General Medical practitioner on the medical list of a Primary Care Trust or Island Health Board, any General Medical Practitioner who is contracted or employed to provide a service to the NHS in Scotland and any staff of such General Medical Practitioners, who are permitted by the Licensee to have access to the Licensee’s Intranet by way of a secure log-in process which verifies the individual’s identity;

11 “Designated Committee” A group of individuals numbering less than 25 (at least 1 of whom must be an Authorised Person created by the licensee and having an advisory, consultative, tribunal or executive function in connection with its activities “Digital Copy” Electronic copies of material licensed for scanning, in whole or in part, in the form of digital dumb or bitmap copies which are direct unaltered copies of the work copied” “NHS Intranet” The computer network(s) operated or controlled by the NHSiS (whether a stand alone network or a virtual network within the Internet) which is accessible only by authorised persons. “Third Party Digital Material”: material in electronic form lawfully supplied to the Licensee by third party document suppliers, for example, but without limitation, press cuttings suppliers, that have been licensed by CLA to provide such a service. For the avoidance of doubt, this does not include any such electronic material provided under any other licence. DEFINITIONS AND INTERPRETATION (continued)
