3. Imagine the result What is the Short Haul Operations Exemption? The HOS Rules provide an exemption for what is called “Short Haul Operations” From an ARCADIS work perspective, two provisions of that exemption are potentially applicable to ARCADIS work activities The following slides present a summary of the exemption requirements

Imagine the result The 100 Air-Mile (115 statute mile) Radius Exemption Drivers are allowed to use this exemption when the: Employee reports to a normal work reporting location and is released from that work within 12 consecutive hours Employee has at least 10 consecutive hours off duty separating each 12 hour duty tour Employee does not exceed 11 hours maximum driving time following 10 consecutive hours off duty Employee will maintain and ARCADIS will keep on file for 6 months accurate time records: Time driver reports to work each day Total number of hours driver is on duty each day Time driver is released from duty each day Total time from preceding 7 days Listen to a summary of the 100 air-mile (115 statute mile) radius exemption

Imagine the result The 150 Air-Mile Radius Property Carrying CMV Not Requiring a CDL Exemption Drivers are allowed to use this exemption when the: Employee driving a CMV does not require a Commercial Drivers License Operates within a 150 air-mile (172.62 statute mile) radius of where employee normally reports and is released from work Employee returns to normal work reporting location at end of duty Employee has 10 consecutive hours off duty separating each on duty period Employee does not drive more than 11 hours following at least 10 consecutive hours off duty Employee does not drive: After 14th hour after coming on duty on 5 days of any 7 consecutive days After the 16th hour after coming on duty 2 days of any period of 7 consecutive days Listen to a summary of the 150 air-mile radius exemption

Employee does not drive: After having been on duty 60 hours in 7 consecutive days if employee is utilizing the 60 Hour Rule After having been on duty 70 hours in 8 consecutive days if employee is utilizing the 70 Hour Rule Any 7-8 day period may end with the beginning of a period of off duty 34 or more consecutive hours long Listen to further discussion on the 150 air-mile radius exemption Employee will maintain and ARCADIS will keep on file for 6 months accurate time records: Time driver reports to work each day Total number of hours driver is on duty each day Time driver is released from duty each day Total time from the preceding 7 days

Imagine the result How to Comply with Time Keeping for the Exemption Compliance with either one of these exemptions may be facilitated through use of dedicated form or logbook providing all of the required information. An example logbook record is presented to the right: Write legibly, neatness is important Corrections may be made using standard ARCADIS accepted practices (line out error and initial date) Use time zone of the office or work location where you are assigned

Intrastate drivers may have different requirements for: - Driving time in 24 hr period - On duty time - Off duty time - Driving limits (60 hr, 70 hr rules) - Obligations related to keeping RODS - Use of the exemptions (100 Air Mile Exemption, etc.) It is important you understand which type of driver you are (intrastate vs. interstate) and know the state requirements, if driving in a intrastate capacity Some general guidance is available on the DOT Program Page of the APEX - Employees following intrastate HOS requirements are responsible for verifying the requirements to be followed

11. Imagine the result I only drive every once and a while as a backup driver, do I keep time records, RODs or what do I keep? If you are a driver, YOU must maintain time records 365 days a year whether you drive a CMV or not The fact you are entering the CMV program as a driver requires you to maintain time records Time records may be kept by any method you learned about today  If you want to do it the super hard way and use RODS forms when not required, more power to you, it is not a violation Look! Remember!
