2 Aim: to set up a Group of TU lawyers and to improve capacities in the SEE TUs for: More efficiant work of the servicies for legal aid in the HTUR protection; HTUR monitoring; Collecting data on cases of violation; TUR protecting Dellivering information for the for the ITUC Annual Survey Submitting complaints to the ILO Committee for the Freedom of Associations Reacting on governments’ reports to the ILO

6 4th WORKSHOP ON TRADE UNION RIGHTS IN SEE COUNTRIES “How to Protect Workers and Trade Union Rights in Private and Multinational Companies“ Montenegro, KOTOR, 11- 13 December 2007 Resource persons: Margarita Tuch– ITUC TUR Department, Brussels Velka Odzakovic- NETLEX member, KSBiH- BiH Enisa Salimovic- ITUC SEE Office

7 Objectives: To discuss position of workers and trade union rights in SEE countries, particularly in private and multinational companies; To encourage SEE TU in their activities on organizing and protecting of workers and trade union rights in private sector and multinational companies, To stimulate trade unionists to use the national, European and international- ILO «mechanisms» in defending trade union rights; To establish regular system of reporting on violation of trade union rights; To sensitivate SEE TU for national, regional and international solidarity and campaigning.

8 5th event: SEE TRADE UNION EXPERTS REGIONAL OPERATIVE MEETING “Improving and protecting workers’ rights in national legislations of SEE countries in line with international and European standards” Montenegro, KOTOR (Trade Union School – MUO), 3- 5 December, 2008 Resource persons: Marina Kasunić- Peris- SSSH, Hrvatska Andrej Zorko- ZSSS, Slovenija Enisa Salimović, ITUC SEE Office Sarajevo

9 The objective of this meeting was: to have the trade union experts from SEE countries to analyze their national labor and social legislation, learn about positive and negative experiences in the region and how national legislations are being brought in line with EU standards and directives, as well as to define standpoints on the fundamental labor rights that need to be protected and promoted in the EU accession process.

10 Conclusions: There is still need for education and further extension of knowledge of Acquis Communautaire and EU directives,harmonization of labor legislation with the EU standards, and techniques and terminology used in the accession process. The intention is to seek assistance in further education from PERC, European Trade Uniojn Confederation and trade unions from the Region, from Slovenia, Croatia, Bulgaria, Romania, Slovakia, and others; This group of legal experts should become a permanent cooperation group and it is necessary to have more people in charge of this topic in detail in each of the trade unions – especially teams of experienced legal experts and young lawyers who speak English

11 Conclusions: The adequate role of the trade union in the screening process requires active SEE regional and national legal expert groups. For the trade unions it is necessary that the legal experts are informed on the special chapter of Acquis Communituaire related to social policy and employment; Grant basic labor rights should be preserved to the full during the screening process, provided that they are in line with the EU directions and legal heritage
