2 Correspondents’ Guidelines:  represent common understanding of all MS on the interpretation of Regulation (EC) No. 1013/2006 on shipments of waste (WSR)  are non-legally binding instruments  contribute to a uniform application of the WSR throughout the EU  could become a basis for a future legally binding instrument  listed in: http://ec.europa.eu/environment/waste/shipments/guidance.htm http://ec.europa.eu/environment/waste/shipments/guidance.htm

3 Currently Version 8 is being revised Expect an agreement on a text in the coming months Guideline directed to:  persons arranging shipments of waste vehicles;  persons arranging shipments of used vehicles;  authorities responsible for the enforcement of the WSR;  garage owners, dismantlers, recyclers, dealers, traders. 4 Distinction among vehicle types non-waste vs. waste & haz. vs. non-haz. waste Type 1: Operational used vehicle ( non-waste ) Type 2: Repairable used vehicle ( non-waste ) Type 2a: Vintage cars/vehicles ( non-waste ) Type 3: Waste vehicle – depolluted ( non-hazardous waste, B1250, 16 01 06 ) Type 4: Waste vehicle wreck not depolluted ( hazardous waste, 16 01 04*)

MS need to come to a final agreement on the criteria and indicators when a vehicle is to be considered waste MS need to come to a final agreement on the criteria and indicators when a vehicle is to be considered a used- or a repairable vehicle (i.e., non-waste)

6 A few examples of Criteria and Indicators Vehicle is a waste:  vehicle cut into pieces;  not suitable for minor repair;  last M.O.T test performed more than 2 years ago;  vehicle has no registration;  discharge of operating liquids;  repair costs (within EU) exceed value of vehicle;  etc., etc.

7 A few examples of Criteria and Indicators, cont. Vehicle is operational, or repairable:  proof of roadworthiness, evidence of testing;  possibility to use a special declaration that the vehicle is repairable;  case of sale: invoice and contract relating to the sale, incl. a guarantee that the vehicle is fully functional  no corrosion or damage;  tyre profile above wear limit;  doors not welded  etc., etc.
