2 EO 13672 Modifies Executive Order 11246 which prohibited discrimination by federal government contractors and sub-contractors on the basis of race, color, religion, sex, or national origin. 13672 adds “sexual orientation and gender identity.” No broad exemptions for religious organizations, but narrow exemption from prior EO remains.

3 Equal Employment Opportunity and Non-Discrimination It is the policy of The Salvation Army that it will provide equal opportunity for employment on the bases enumerated in the Federal, State and local laws applicable to it, except where a prohibition on discrimination is inconsistent with the religious principles of The Salvation Army. Such equal opportunity for employment will apply to recruitment and hiring, training, promotion, salaries and other compensation, transfers and layoffs or termination. As a religious organization, a branch of the Christian church, The Salvation Army reserves the right to Impose qualifications based on religion if such qualifications are related to a bona fide religious purpose or are otherwise permitted by applicable law. make such employment decisions and adopt employment policies (including employee benefits) which are calculated to promote the religious and moral principles for which it is established and maintained, consistent with its rights to the free exercise of its religion guaranteed to it by the Constitution of the United States. Without limiting the foregoing, by accepting employment with The Salvation Army, an individual recognizes that The Salvation Army is a church, agrees to do nothing to undermine its religious mission, and acknowledges that his or her conduct must not conflict with or undermine the religious programs of The Salvation Army, or its religious and moral purposes.

11 Combined Federal Campaign Historically, TSA has participated in the Combined Federal Campaign at the local level. Some local units have been told they do not qualify due to accountability standards. The standard referenced is that governing board be “independent” defined as uncompensated. Board of Trustees members are SA officers who are compensated. NLC reached out to director of combined federal campaign to get agreement that we met that standard or get a waiver. The CFC could not conclude that we meet the standard. Then NLC went to office of personnel management for a waiver. The director of office of personnel management could not conclude we met standard or issue a waiver. They did acknowledge we receive funds and that the receipt of funds from the campaign was not wrong. It is basically still up to the local board of the Combined Federal Campaign. We could seek an amendment of the regulation or go back and seek a waiver at some point. We have recommended waiting for upcoming elections to decide on a next step direction.
