2 Changes in Child Nutrition Program Law and Regulations Pennsylvania Department of Education, June 2005 P.L. 108-265, Section 111 Effective Date is July 1, 2005 or beginning with 2005 – 2006 School Year Food Safety and Sanitation

3  All Sponsors of the NSLP must have at least two food safety and sanitation inspections per year.  Inspections are to be carried out by local health departments or Pennsylvania Department of Agriculture (PDA), Bureau of Food Safety and Laboratory Services, when local health departments do not exist or when local health departments do not conduct food safety and sanitation inspections of schools. 4  By June 30, 2006, schools must have documentation of two food safety and sanitation inspections for all food production areas.  An official report on the food safety and sanitation inspections must be posted in a publicly visible location and made available to any member of the public on request.  The State must audit food safety and sanitation inspections beginning in 2006. 5 It is the responsibility of the school to do everything possible to ensure that two food safety and sanitation inspections are conducted during the school years. 1.Do you know who is responsible in your area for conducting inspections? PDA, county or city health department? Look at history of past inspections! Know the name of inspector and telephone number! 6 2. Contact the PDA or health department, in writing, and notify them of the new requirement for two inspections. Keep a copy of the letter on file and documentation of their response to you! 8 Each sponsor of the NSLP must implement a food safety program, in the preparation and service of each meal served to children, that complies with any hazard analysis and critical control point system established by the Secretary, United States Department of Agriculture. 9  HACCP guidance from USDA is expected to be available to SFAs prior to the compliance date of July 1, 2005.  USDA views School Year 2005/2006 as the implementation year but encourages SFAs to wait for the HACCP guidance to implement their HACCP-based food safety program. 10  The National Food Service Management Institute is developing technical assistance and training to help SFAs comply with this requirement.  Serving it Safe is an excellent resource for ensuring a safe foodservice operation, but it is not the guidance required by the Child Nutrition and WIC Reauthorization Act of 2004.
