World Class Standards SEM26-01 1 How can ETSI help? The regulatory environment in the European Union

World Class Standards SEM26-01 2 What do I have to do to meet European Telecommunications regulations?

World Class Standards SEM26-01 3 Directives & regulations (equipment) Radio & Telecommunications Terminal Equipment (RTTE) Directive (1999/5/EC) (under revision) ElectroMagnetic Compatibility (EMC) Directive 2004/108/EC (updates 89/336/EEC) Radio Spectrum Decision 676/2002/EC

World Class Standards SEM26-01 7 Directives & regulations Talk to ETSI! Who can help?

World Class Standards SEM26-01 … working by consensus 8 Recognised European Standards Organisation (98/34/EC) … with direct participation… Association of stakeholders… …manufacturers, network operators, service providers, administrations, users, industry associations … What is ETSI?

World Class Standards SEM26-01 9 Directives & regulations (equipment) e.g. Radio & Telecommunications Terminal Equipment, EMC, Safety New Legislative Framework Replaces New Approach EP/Council Decision 768/2008/EC EP/Council Regulations 764/2008 & 765/2008 Conformity Assessment modules Essential requirements Harmonized Standards Notified Bodies Declaration of Conformity & CE mark

World Class Standards SEM26-01 10 What does a manufacturer need to do? (RTTE Directive) Meet the essential requirements health & safety electromagnetic compatibility avoidance of harmful interference (radio equipment only) possibly others, if invoked by the Commission Carry out « essential radio test suites » Declare conformity Inform member state (if using non-harmonised radio spectrum) Meet national radio interface regulations

World Class Standards SEM26-01 11 How can ETSI help (1/4)? Harmonised Standards Harmonized Standards? Are there any others? How do I meet essential requirements?

World Class Standards SEM26-01 12 Other essential requirements Access to emergency services (3.3e) Ships using inland waterways (EC Decision 2000/637/EC) Marine distress & safety equipment (EC Decision 2004/71/EC) Marine Identification System (EC Decision 2005/53/EC) Avalanche beacons (EC Decision 2001/148/EC) COSPAS-SARSAT locator beacons (EC Decision 2005/631/EC) Automatic Identification System (AIS) (EC Decision 2005/53/EC)

World Class Standards SEM26-01 13 Harmonised Standards Where apparatus meets the relevant harmonised standards or parts thereof whose reference numbers have been published in the Official Journal of the European Communities, Member States shall presume compliance with those of the essential requirements referred to in Article 3 as are covered by the said harmonised standards or parts thereof. [RTTED: Article 5.1]

World Class Standards SEM26-01 14 Harmonised Standards European Standards (EN) Produced under a mandate from the European Commission And adopted by Member States (98/34 committee) Implement essential requirements of a « New Approach » Directive (e.g. R&TTE, EMC) Adopted by National Standards Organisations Cited in the Official Journal of the European Union Member states required to presume conformity

World Class Standards SEM26-01 15 Harmonised Standards Mandate M/284 (& specific mandates) Identify technical requirements necessary to meet regulatory objective (essential requirements) Identify « essential radio test suites » necessary before placing on the market Only the part of the standard relevant to the Directive is cited in the OJEU

World Class Standards SEM26-01 16 Some Harmonised Standards... MSG: GSM DECT: DECT TETRA: TETRA ERM/MSG TFES: IMT-2000 ATTM: Fixed Radio Links SES: Satellite Earth Stations ERM: Land-mobile radio, Amateur Radio, Citizens Band, RFID (ERM TG34) ERM: 2,45 GHz RLAN BRAN: HIPERACCESS, 5 GHz RLAN

World Class Standards SEM26-01 17 ERM: Marine radio, Short-range devices (ERM TG28), Paging, Cordless telephones, Radar, Medical Implants, Road Transport & Traffic Telematics ERM: Electromagnetic Compatibility, Meteorological Aids, Avalanche Beacons, Ultra Wide Band (ERM TG31a), Broadcast transmitters, professional audio/video Some more Harmonized Standards

World Class Standards SEM26-01 18 Co-ordinated in ETSI by OCG Steering Committee OCG_RTTED Commission refers regulatory issues to TCAM ETSI is a permanent observer in TCAM

World Class Standards SEM26-01 19 But …??!! How can Administrations be sure that standards protect the spectrum adequately? Technical requirements are set by consensus of Administrations and Industry, in co-operation with CEPT What to do with non-compliant equipment? Effective market-surveillance is key Members States shall take steps to remove non-compliant equipment from the market But what is theres a mistake in the standard? Revisions can be initiated quickly Safeguards can be invoked in worst cases

World Class Standards SEM26-01 20 How can ETSI help (2/4)? …working with CEPT How do I meet national radio interface regulations? Harmonised Frequencies

World Class Standards SEM26-01 21 Obtaining spectrum in Europe Creation of SRDoc Creation of candidate HS Creation of Decision / Recommendation Creation of EC Decision ECC RSCom National frequency allocations National licensing regimes Citation in Official Journal of the EC Spectrum allocation with legal certainty Harmonized Standard System Reference Document (SRDoc) Candidate Harmonized Standard ECC Decision/ Recommendation EC Decision World Radio Conference (WRC) Global spectrum allocation Spectrum requirement From ETSI members, EC etc ETSI Liaison Officer ETSI Representative

World Class Standards SEM26-01 22 CEPT - ETSI MoU Working Groups (decide) Project Teams (draft) ETSI Member ETSI Liaison Officer Overall ETSI view Individual view Decision on spectrum CEPT ETSI input (System Reference Document)

World Class Standards SEM26-01 23 Basic description of application Simple technical description Current ETSI standards Justified spectrum requirements Possible compatibility issues Market forecasts Traffic evaluation Economic/social benefit Market window Requested action from CEPT Guide EG 201 788 System Reference Document Spectrum: How do we get an ETSI input?

World Class Standards SEM26-01 24 SRDoc to CEPT System Reference Document Spectrum: How do we get an ETSI view? Affected ETSI TBs Is there consensus? Have all interested parties been consulted? Resolution by members of affected TBs TC ERM

World Class Standards SEM26-01 25 Example: 2W RFID working at UHF Modification to annex 11 of CEPT/ECC/Rec 70-03 EN 302 208 Harmonised Standard National licence regimes plus interface regulations ETSI CEPT SRDoc TR 101 445

World Class Standards SEM26-01 26 How can ETSI help (3/4)? Harmonised Frequencies …working with the European Commission… Frequency allocations are National …Radio Spectrum Decision 676/2002/EC What about legal certainty in EU?

World Class Standards SEM26-01 27 The problem… … and inform user of national restrictions on use …and inform each member state 4 weeks before marketing equipment… I need to know all National frequency regulations… Frequencies are managed on a national basis: CEPT Recommendations not enforceable in European law

World Class Standards SEM26-01 28 The Radio Spectrum Decision (676/2002/EC) Radio Spectrum Committee (RSCOM) European Commission requests CEPT to provide frequency allocations in support of EU policies CEPT output codified into a Commission Decision Legal certainty ! CEPT and ETSI are permanent observers

World Class Standards SEM26-01 29 Example: 5 GHz Radio LAN Radio Spectrum Committee Request (mandate) to CEPT on frequencies for Radio LAN CEPT/ECC Decision (04)08 in use of 5 GHz band for Radio LAN ETSI Harmonized Standard EN 301 893 (BRAN) Commission Decision 2005/513/EC Legal certainty for placing on the market and use in EU/EFTA
