Geneva, October 9, 2012 GSC16bis-IPR-06 7 TTA IPR Policy IPR Disclosure –Anyone proposing a TTA standards item or anyone having interests in it, from the outset, draw the attention of TTA to any known IPR or to any known pending IPR application, by notifying relevant information to the Secretariat of TTA. Terms and Conditions for granting licenses –without compensation and on a non-discriminatory basis –reasonable terms and conditions and non-discriminatory basis TTA responsibility –TTA shall not be responsible for the accuracy and validity of relevant IPRs claimed by IPR holders, and –TTA shall not be involved in the arbitration of disputes between IPR holders and users of TTA standards.

8. Geneva, October 9, 2012 GSC16bis-IPR-06 8 TTA IPR Issues TTA has not yet revised the TTA IPR Policy of Dec. 2006. There are some issues relating to TTA IPR Guidelines such as : –Transfer ownership of IPRs; –S/W Copyrights; or –IP Database regular update. Etc. There is also concern about copyrights in case of referring or incorporating the other SDOs standards into TTA standards.

9. Geneva, October 9, 2012 GSC16bis-IPR-06 9 Antitrust Issue (1/2) Jan. 2012, Fair Trade Commission of Korea published the guidelines for Standardization. Model Operating Guidelines for Standards Setting Organizations for Voluntary Compliance with the Monopoly and Fair Trade Act This guidelines includes the basic principles : –Give interested parties equal opportunities of participation in the standard setting process. –Need a transparency in operating the standard setting procedure. –Establish and enforce reasonable and clear intellectual property rights policies.

Geneva, October 9, 2012 GSC16bis-IPR-06 10 This guidelines also includes the specific operating procedures relating to : –Participation of SSOs and Scope of discussions ; –Decision making for standard setting; –Disclosure of IPRs; –FRAND comittment; –Measures to guarantee this guidelines; and etc. Antitrust Issue (2/2)
