2 2 Rules Regarding Competition (Law of Georgia on Civil Service, articles 29- 36) Current Situation Outcome According to the amendments the law shall determine only basic rules regarding competition The rules of conducting competition will be determined in detail by the Decree of the President According to the Decree of the President institution shall be obliged to inform candidates in writing about the decision concerning their candidacy no later than one month after the competition end s (regards to the negative decisions too) Law of Georgia on Civil Service determines the rules of competition announcement/conduction in detail. Besides Decree of the President actually repeats those rules

3 3 Announcement of vacancies by Legal Entities of Public Law via www.hr.gov.ge ( Article 11 1 is added to the Law of Georgia on Civil Service) www.hr.gov.ge Current Situation Outcome Due to current changes, Legal entities of Public Law are obliged to announce any vacancies on www.hr.gov.ge (except religious, educational and cultural legal entities of public law)www.hr.gov.ge Those changes make recruitment procedures more transparent According to the current legislation legal entities of public law do not announce vacancies via www.hr.gov.ge

4 Competition Announcement by the Self-Government Organizations 4 CurrentSituation Today Self-Government Organizations are obliged to announce vacancy in local newspapers Outcome This limitation will be cancelled and will be left only the obligation to announce any vacancie on www.hr.gov.gewww.hr.gov.ge

5 Abolishment of the Selection and Certification Commissions ( Law of Georgia on Civil Service, articles 33 -36) 5 CurrentSituation Today every institution is obliged to have a Selection and Certification Commission Outcome Due to the amendments obligation of having Selection and Certification Commissions will be abolished The issue of creation of these commissions will be the discretion of the organizations heads

6 6 Main requirements for civil servants (Law of Georgia on Civil Service, article 15) CurrentSituation. Outcome According to the current legislation capable citizen of Georgia, who has relevant knowledge and experience and has reached 21 years, can be appointed as a civil servant Due to the amendments minimum age for civil servants has been decreased from 21, to 18 (is equalized to the self-government servants age)

7 7 Job Descriptions ( Article 71 1 is added to the Law of Georgia on Civil Service ) Current Situation Today job descriptions are described only for the vacant positions in the case of competition announcement Outcome The job descriptions will imply clarity in the working process by defining key areas of employee’s responsibility, as well as define reporting, supervision and appraisal procedures Recommendations of international organizations and local NGOs (SIGMA,OSGF) will be performed

8 Appointment of Temporarily Acting Civil Servant 8 (Paragraph 2 is added to the article 30 of the Law of Georgia on Civil Service ) Current Situation Current legislation foresees the appointment of temporarily acting civil servant without competition for indefinite employment period Outcome According to the amendment the appointment of temporarily acting civil servant will be permitted once. The deadlines for holding acting positions have also been defined -1 year for acting high officials and 2 month for all other civil servants. The need of conducting competitions for the appointments in civil service will arise

9 Probation Period 9 CurrentSituation The Law of Georgia on Civil Service practically excludes using of the probation period Outcome Changes will significantly increase the prospects of recruiting qualified and skilled staff ( Article 24, paragraph 4 of the Law of Georgia on Civil Service will be abolished )

10 Removal of mandatory certification and introduction of a new appraisal system (Law of Georgia on Civil Service, Chapter VIII ) 10 CurrentSituation Inefficient appraisal system, which is not used in practice It is impossible to identify real abilities of civil servant through current appraisal system Outcome Each institution will individually collaborate effective appraisal system. Appraisal will be conducted no less than once in a year Agreement on the goals between civil servants and their supervisors ( no less than once in a year main directions of job, terms of performance, terms of reports, its forms and other significant issues will be agreed)

11 Promotion ( Article 77 of the Law of Georgia on Civil Service will be abolished ) 11 CurrentSituation According to the Law of Georgia on Civil Service promotion of civil servant is possible without competition Outcome Due to the amendments civil servant will be promoted only via competition

12 Strengthening the role of Civil Service Bureau of Georgia ( Article 130, Paragraph 2, Sub paragraph s “d 1 ” will be added) 12 CurrentSituation According to the Law of Georgia on Civil Service Civil Service Bureau has a significant role in developing public service, but its functions is limited in this field and has only the function of studying and analyzing, coordination and methodical assistance Outcome According to the amendments CSB will be able to issue guidelines, standards and recommendations and supervise fulfillment of those.

13 Abolishment of the Civil Servants Obligation to Submit Declaration ( Article 18, paragraphs 1-3 of the Law of Georgia on Civil Service will be abolished and amendments will be carried out in article 2, paragraph1) 13 CurrentSituation Pursuant to the Law on Civil Service of Georgia, civil servant is obliged to submit asset declaration (personal and family property and income) to the ministry of Finance upon entry into the civil service and annually thereafter These declarations carry neither tax purpose, nor they are publicized for accountability purposes. Outcome According to this amendment only civil servants holding higher positions and falling into the corruption risk group category will be requested to submit asset declarations to the Civil Service Bureau Administrative/bureaucratic burdens will be decreased for the civil servants entering and publicity and accountability will be encouraged as these declarations will be publicly posted on the web page www.declarations.gov.ge

14 After the abolishment of the Civil Servants Obligation to Submit Declaration following officials will submit asset declarations to the Civil Service Bureau in addition City Local governing body members (Tbilisi, Batumi, Rustavi, Poti, Kutaisi) As well as the local governing and executive body, and their deputies As well as district and city district heads of local executive bodies 14
