Definition: – By medical point: a physical or mental impairment that has a substantial and long-term adverse effect on his/her ability to carry out normal day- to-day activities. – By social point: It is the traditional concept which causes the individuals to be “disabled” in the environment. Ex: No ramps in buildings.

Introduction: – Definition of “disabled” – My question…How to improve the disabled's life quality? Body: – By individual  Cultivate hobbies ÷ Sports ÷ Drawings  Join clubs  Counseling – By social  law ÷ The law in foreign countries (UK) ÷ The law in Taiwan  Welfare  foundations + Conclusion: – Sports: We can held all sorts of contests or tournaments – Law: The law hasn’t achieve its goal but is on its way.

How will you improve the life quality of the disabled?

Disabled’s Welfare + Disability Law – UK: DDA – Taiwan:Physically and Mentally Disabled Citizens Protection Act + Disability Foundation – Liu educational consulting( 財團法人劉氏社會福利事 業基金會 ) – Republic of China Association For Mentally Handicapped Person( 中華民國啟智協會 ) – The League of Welfare Organization for Disabled R.O.C.( 中華民國殘障聯盟 )

It was legislated to make ”discriminating against disabled persons in connection with employment, (…)” to be unlawful. + Service providers have had to make 'reasonable adjustments' for disabled people, such as providing extra help or making changes to the way they provide their services. + Consolidated into the Equality Act (2010). PASSIVE ->ACTIVE

less favorable treatment for a reason related to a disabled person's disability + failure to make a "reasonable adjustment"

For adjustment: The Disability Rights Commission's Codes of Practice: – whether the proposed adjustment would meet the needs of the disabled person – whether the adjustment is affordable – whether the adjustment would have a serious effect on other people + The Act therefore permits employers and service providers to justify less favorable treatment in some circumstances.

Exemption of small firms(15 employees under) + ‘reasonable adjustment’ clause that enables employers to justify some non-adherence + monitoring of compliance by employers + Narrow definition of disability + Puts burden of proof upon the disabled – Prove they are disabled under the terms of act – Discriminated against on this basis

Probably DDA needs a longer time to make a detectable effect. + There are other factors which effect employ rates, such as recession. + There are no other information about the experience of DDA, so it is hard to any definite conclusions.

The employment gap isn’t closed after the onset of DDA. On contrary, it increased. – DDA is a disguised form of suppressing the disabled. + The disadvantages of DDA shouldn’t be neglected, and addition to the act is needed.

Origin: – Disabled Welfare Law for amendments to the Action Committee( 殘障福利法修正行動委員會 ) – ( 全國性民間團體聯盟組織 ) – The League of Welfare Organization for Disabled R.O.C.( 中華民國殘障聯盟 )
