2 Any initiative of Government Many bills in Senate and Chamber of Deputies In Senate the Commission of Costitutional Affairs started the discussion of 11 bills. First approval by September 2015, final entry into force by next April (hopefully) Il Chiostro has been heard by Senate Commission 2

3 Call a halt to unacceptable regulatory gap Define a task crucial for the functioning of democracy Need of more efficient and professional communication between interests’ representation of profit and non profit organizations and institutions Give equal opportunity to all the interests represented Improve the quality of public decisions 3

4 Avoid legislative fragmentation with regional laws Standardize the rules for the different institutions Ensure procedures to any legislative act (also administrative) 4

5 Lobbying: activity that contributes to the adoption of public decisions by respecting the autonomy of the institutions and with the obligation of loyalty to them, based on the principles of transparency and fairness. Public decision-makers: the widest possible audience including legislators, members of the government, Public Administration, Regulatory and Supervisory Authorities, Councils and Regional Governments, Local institutions. Courts excluded. 5

6 Mandadory Register for anyone who wishes to deal with public decision makers (including Unions, Industrial Associations, religious and no-profit organizations etc. – (excluding political movements and parties) Integrity requirements for those who get registered (no sentences for significant crimes) Incompatibility for those who exercise public functions and for those who, by virtue of their role, have privileged access to institutional seats and information No revolving doors (2-4 years) for those who have held a public office 6

7 Timely access to information and consultation procedures through a special access to a reserved database of drafts of legislation Access, without discrimination, to all institutional seats Participation in decision-making activities (impact assessments of regulation, before and after the entry into force of laws and regulation Presentation of meeting requests, proposals, claims, suggestions, studies, research, analysis, pleadings and documents 7

8 Annual report on the activities carried out and on the resources used Compliance with the Code of Conduct, enforced by the law Identifiability of lobbyists and transparency in their relations with institutions Prohibition of gifts or benefits given to public decision makers( annual value no more than 200 €) 8

9 Prohibition of any type of unappropriate pressure that can limit the autonomy of the public decision makers Prohibition of illicit traffic of influences Prohibition of direct and indirect financing of political parties 9

10 Cannot refuse to receive requests and proposals Must mention the proposals, the requests received and the meeting with lobbyists during the legislative developments Must ensure the access to documents and communications related to decision-making processes under way 10

11 Identifiability of the lobbyist and of the represented interests Obligation to provide correct and not misleading information to the institutions Ban on trade of information obtained as part of decision-making procedures Prohibition of using dishonest methods to obtain informations 11

12 Prohibition of undue pressure Proper use of the informations given to Register, without cheating Compliance with the obligations of confidentiality, concerning the information received by public decision makers Prohibition to mislead policy makers Prohibition to induce policy makers to contravene their rules of behavior 12

13 Supervision entrusted to ANAC ( Anticorruption National Authority) a powerful Supervisor that can control any act of Public Administration Failure to register (fine by 50.OOO to 200.000) Untrue informations (from 5,000 to 100,000) Violations of the Code of Conduct: disciplinary procedures (censure, suspension, perpetual striking off) 13

14 Better quality of legislation and regulation Boost for economic recovery Equality of opportunities: even small and medium enterprises (95% of italian enterprises), smaller economic entities and non-profit organizations may influence the decision-making process A new and well skilled generation of professionals of Government Affairs A "mass of lobbyists" that encourages a proper dialogue between associations, institutions and organized citizenship 14
