1. 1 Executive Summary Positive Prevention HIV/AIDS Education Program In order to be compliant with Ed Code sections 51930-51939, Lodi Unified School District must: Implement a compliant HIV/AIDS Prevention Education curriculum in middle and high school. In LUSD the changes include: – Passive (not active) parent/guardian permission – Materials will follow state compliance guidelines – All 7 th and 9 th grade students will receive HIV/AIDS prevention education – Instruction to include abstinence plus information on the manner in which HIV/AIDS is and is not transmitted Revise school board policies 6142.1 and 6142.2 to reflect changes in the law pertaining to HIV/AIDS prevention education.

3. 3 Authorized vs. Required Education EC 51933 “School districts may provide comprehensive sexual health education…in any kindergarten to grade twelve, inclusive…” (authorized). EC 51934…all pupils in grades seven to twelve, inclusive, receive HIV/AIDS prevention education…at least once in middle school and at least once in high school. (required). EC 51934 (3) Abstinence may be taught within the context of HIV/AIDS prevention education however, abstinence-only education is not permitted in California public schools.

4. 4 Why Revise LUSD HIV/AIDS Prevention Education? LUSD must be compliant with current Education Code. State requires Abstinence “Plus” Education (the plus being outlined in this presentation). District must have a consistent and uniform HIV/AIDS curriculum in all Middle and High Schools. Current LUSD Board Policy must be revised to align with State Education Code.

8. 8 Education Code 51931 Comprehensive Sexual Health Education is education regarding human development and sexuality, including education on pregnancy, family planning, and sexually transmitted diseases.

9. 9 Education Code 51931 (continued) HIV/AIDS Prevention Education is instruction on the nature of HIV/AIDS, methods of transmission, strategies to reduce the risk of human immunodeficiency virus (HIV) infection, and social and public health issues related to HIV/AIDS. HIV/AIDS prevention education is not comprehensive sexual health education.

Instruction shall emphasize sexual abstinence, monogamy, avoidance of multiple sexual partners, and abstinence from intravenous drug use. b. Instruction shall include the latest statistics on the success and failure rates of condoms and other methods of contraception to prevent sexually transmitted HIV. c. Information on other methods that may reduce the risk of HIV transmission from intravenous drug use (EC 51934).

Discussion about societal views on AIDS, including stereotypes and myths regarding persons with AIDS and emphasizing compassion for people living with HIV/AIDS.

18. 18 Requirements for Instruction 1. Instruction and materials shall be age appropriate. 2. All factual information presented shall be medically accurate and objective. 3. Instruction shall be made available on an equal basis to pupils who are English Learners (EC Code 51933). 4.Instruction and materials shall be appropriate for use with pupils of all races, genders, sexual orientations, ethnic and cultural backgrounds, and those with disabilities.

Instruction and materials shall be accessible to pupils with disabilities, including, but not limited to, the provision of a modified curriculum, materials and instruction in alternative formats, and auxiliary aids. 6. Instruction and materials shall encourage a pupil to communicate with his or her parents or guardians about human sexuality. (EC Code 51933).

20. 20 Positive Prevention HIV/AIDS Program Positive Prevention is a comprehensive (two week) curriculum designed to provide California adolescents with the information and support they need to choose behaviors that reduce their risk of becoming infected with HIV which causes AIDS, and related STD’s Positive Prevention is a collaborative project of the American Red Cross, the CDE, and the California Department of Health Services
