3 Campus Training Guide 9/11/08 3 Purpose for Training This training is intended to provide guidance in the additional steps necessary to comply with accessibility requirements for the purchasing of Electronic and Information Technology (E&IT) products. As a general rule, purchasing E&IT products should follow the same policies and procedures as for purchasing all other goods and services, including E&IT goods and services, that are not subject to accessibility requirements.

4 Campus Training Guide 9/11/08 4 OVERVIEW What is the Accessible Technology Initiative (ATI) and Section 508 of the Rehabilitation Act Law? This Law applies to all purchases of E&IT products that are over $15,000 from September 08-09, as of September 1, 09 it will apply for E&IT products that are over $2,500.

5 Campus Training Guide 9/11/08 5 What is Accessible Technology and Section 508 The CSU system has launched a system-wide Accessible Technology Initiative (ATI) to ensure that each CSU campus follows state and federal laws mandating access to technology. Accessibility for all is a priority at Cal State San Marcos. We are committed to providing an environment that enables all persons to be successful in attaining an education and information on or about our campus.

If you are the individual who is requesting the purchase of an E&IT product or service you will need to: Determine the requirement for the requested product or services; Look for sources that can supply the requirement; Complete the E&IT Checklist found at: http://www.csusm.edu/fas/fasforms.html;

Continued Develop functional requirements (specifications) for the requested products or services for all Requisitions, Quotes and Bids; When processing a PeopleSoft Requisitions for the purchases of E&IT products and services please note in the Header Comments “That the E&IT Checklist has been email to the 508 Compliance Officer for approval”. You must check the “Send to Vendor” box (this box must be checked so it will print on the requisition).

14 Campus Training Guide 9/11/08 14 Glossary ATI: Accessible Technology Initiative Electronic and Information Technology (E&IT): Includes information technology and any equipment or interconnected system or subsystem of equipment, that is used in the creation, conversion, or duplication of data or information. The term electronic and information technology includes, but is not limited to, telecommunications products (such as telephones), information kiosks and transaction machines, World Wide Web sites, multimedia, and office equipment such as copiers and fax machines. The term does not include any equipment that contains embedded information technology that is used as an integral part of the product, but the principal function of which is not the acquisition, storage, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information. For example, HVAC (heating, ventilation, and air conditioning) equipment such as thermostats or temperature control devices, and medical equipment where information technology is integral to its operation, are not information technology.

15 Campus Training Guide 9/11/08 15 Glossary Continued California Government Code 11135 © (2): State of California statute that prohibits discrimination against people with disabilities in any program or activity that is conducted, funded directly by, or receives any financial assistance from the State. This section brings into State law the protection of Title II of the Americans with Disabilities Act which ensures accessibility to programs; Section 504 of the Rehabilitation Act of 1973; and Section 508 of the Rehabilitation Act which requires the procurement of accessible electronic and information technology. Requires that any entity that contracts to provide electronic and information technology products or services shall agree to respond to and resolve any complaint regarding the accessibility of products or services provided.508 Standards: Rehabilitation Act of 1973: Federal civil rights law that prohibits discrimination against persons with disabilities. This law applies to programs conducted by Federal agencies, entities receiving Federal funds (such as colleges participating in Federal student loan programs), Federal employment, and employment practices of businesses with Federal contracts. Voluntary Product Accessibility Template (VPAT): is a standardized form this comes from the vendor and is used for E&IT products to access how they met the key regulations of Section 508 of the Rehabilitation Act.

16 Campus Training Guide 9/11/08 16 Glossary Continued Section 508: In 1998, Congress passed the Workforce Investment Act that strengthened Section 508 of the Rehabilitation Act of 1973 (Section 508). It requires Federal agencies to develop, procure, maintain or use electronic and information technology so that Federal employees and members of the public with disabilities would have access to and use of information and data comparable to that of employees and members of the public without disabilities. In California, Section 508 was codified in Government Code 11135 (.pdf) by the State Legislature in 2002 through S.B. 105 (.pdf). Government Code 11135 requires CSU to comply with the accessibility requirements of Section 508 of the Rehabilitation Act of 1973 as amended, and to also apply the US Access Board accessibility standards to the electronic and information technology products and services that it buys, creates, uses and maintains.Government Code 11135S.B. 105 Link to more information on Section 508: http://www.calstate.edu/accessibility/section508/

17 Campus Training Guide 9/11/08 17 Glossary Continued Section 508 Standards: CSU web sites need to conform to Section 508 Standards for Web-based Intranet and Internet Information and Applications. This set of standards contains 16 specific points (a) through (p).
