4 UC owns and protects Multiple trademarks including, without limitation, its name, logos, colors, helmets, uniforms, slogans, mascot, distinctive landmarks, and other indicia Licensing program established by the Board of Trustees Protects the university’s name and identifying marks Prohibits unauthorized use of its marks Controls and monitors use of its trademarks to ensure protection under trademark laws UC charges a royalty fee for use of its marks except For internal consumption items -and- Limited other exceptions on a case-by-case basis Policy Background

6 What are they? Items that Are purchased using university funds Happen to bear a UC trademark Are used by an employee or org unit in the ordinary course of business Examples: pens, notebooks, required uniforms Items produced for an employee/org unit for internal consumption May be exempt from the royalty requirement at the discretion of the director of (Office of Trademarks & Licensing) Items for Internal Consumption

7 What are they? Items that Bear a UC trademark Are purchased to promote a specific university event Example: t-shirt given to students or employees for an event Promotional items purchased with university funds Must use a date or event specific design Must follow appropriate branding guidelines May be exempt from the royalty requirement at the discretion of the director (Office of Trademarks & Licensing) Promotional Items

8 Prior approval by the Office of Trademarks & Licensing is required for: All uses of UC’s trademarks on products Even if proposed uses do not involve sale of the product Examples: items for giveaway, items for conferences, meetings, etc. Required Approvals

9 Rights for the use of university marks to another entity: May be assigned only by the director, Office of Trademarks & Licensing May not be assigned or otherwise granted permission for use by any UC org unit, group or registered student organization Assignment of Rights

10 Products bearing UC trademarks must: Incorporate the appropriate trademark designation symbols (i.e., ® or ™) Be produced from companies licensed by UC through the Collegiate Licensing Company (CLC) For a list of licensed companies, go to the Office of Trademarks & Licensing websiteOffice of Trademarks & Licensing and click on “Licensees.” Use of a University Trademark

11 UC trademarks used in conjunction with the name or trademark(s) of any other entity: Require prior written permission of that entity Require prior approval by UC’s Office of Trademarks & Licensing Are limited to instances of compelling institutional priority Use of a University Trademark

12 Are approved for use subject to review and approval by Office of Trademarks & Licensing: For the Athletics Department For athletic-related events on a case-by-case basis By official student organizations and clubs (i.e., those recognized by the Office of Student Activities and Leadership Development) Use of the C-Paw (and Athletic Marks)

13 UC trademarks may not be used: In any manner that suggests or implies the university’s endorsement In any way that discriminates or implies discrimination In connection with products or designs that Present an unacceptable risk of liability -OR- Could be harmful to the mission or image of the institution For examples of such products or designs, go to the Office of Trademarks & LicensingOffice of Trademarks & Licensing website and click on “Guidelines.” Inappropriate Uses of University Trademarks

14 [Begin this process early to allow sufficient time] 1. Complete the UC Licensing Internal Request Form.UC Licensing Internal Request Form 2. Submit completed form and artwork to Linda Schoenhoft (Linda.Schoenhoft@uc.edu).Linda.Schoenhoft@uc.edu 3. Office of Trademarks & Licensing reviews request and returns signed copy of request indicating (a) Request approved (b) Request approved with changes and description of required changes (c) Request is denied along with the reason 4. For approved requests*, the org unit can place an order with an approved vendor. *Note: approval to use a UC trademark does not constitute approval to use the trademark again, or in conjunction with any other item, or to change the design in any way, without seeking additional approval.
