2 ADMINISTRATIVE COMMITTEE OF THE FEDERAL REGISTER (ACFR) Archivist of the United States Representative of the Attorney General Director of GPO (formerly the Public Printer) The Director of the OFR serves as secretary for the committee ACFR owns and issues regulations in 1 CFR Chapter I

4 ACFR TIMELINE Last significant revision effective January 1973 Minor changes for clarification and advent of new technology (like the internet) Summer/Fall 2014 – OMB Interagency review October 2014 – Proposed rule published December 2014 – comment period extended January 28, 2015 – comment period closed

5 IBR TIMELINE December 2011 – ACUS Recommendation 2011-5 February 2012 – Petition sent to OFR – Petition with request for comments published October 2013 – Proposed rule published November 2014 – Final rule published January 6, 2015 – Final rule in effect

6 CONTINUING REQUIREMENTS Review at final rule stage 20 working days for review, pre-publication Language requirements in: DATES List of Subjects Regulatory text Signed request letter Complete draft rule All standards to be IBRed

7 NEW REQUIREMENTS (FINAL RULE) New discussion in preamble: Summary of each standard newly IBRed or changed (doesn’t apply to an existing, unchanged standard) Statement explaining why standards are reasonably available All other final rule requirements remain in place

8 NEW REQUIREMENTS (NPRM) Proposed rule review concurrently with publication review (but OFR can kill NPRM if IBR requirements not met) No language in DATES and no regulatory text language required (but encouraged) Term still in List of Subjects New discussion in preamble: Summary of each standard proposed for IBR Statement explaining why standards are reasonably available at proposed rule stage and through comment period

9 ITEMS OF NOTE OFR has not killed any NPRMs for missing or incomplete language Most documents submitted since January have had only minor issues Longest delay in scheduling a document has been 3 days while working out language Agencies are always welcome to email draft NPRMs for review to ensure minimal time for IBR review Final Rule approvals completed before January 2015 don’t need to add new language as long as submitted for publication before end of September OFR plans to have new IBR Handbook posted around the end of June 2015
