1 Time Line of Events – 7 vs 8 days pay - Monday, September 15 – BCPSEA and BCTF reach tentative contract agreement - Wednesday, September 17 – parties negotiate Return To Work Agreement (RTWA) - Wednesday, September 17 – 11:20pm parties reach agreement on RTWA - Thursday, September 18 – BCTF members vote to accept deal (including RTWA) which are both endorsed by the union executive - Friday, September 19 - BCPSEA member school districts finalize vote to endorse agreement - Friday, September 19 – Teachers return to work and ALL contract teachers paid for the day - Monday, September 22 – students return to classes 1

2 Content of the RTW Agreement - the new Collective Agreement (CA) came into effect on Friday, September 19 th - All contract teachers returned to work on that same day - On the first day of work (Friday), contract teachers were not required to attend their work place; nor to specify any work being done in order to be paid for this full day (regardless whether they are on a full-time or part-time contract) - On the following Monday, all students returned to full classes and all teachers returned to their regular work schedule and place(s) of work - there was no request from the BCTF for variance from the CA other than the agreement that the Friday be a paid work day for all contract teachers 2

3 3 The following is subject to the union's ratification of the tentative agreement: 1.The parties agree on the language setting out changes to the collective agreement, as per the attached memorandum. 2.Friday will be a paid day. There will be no pickets, and there will be no interference with the return to work of support staff. Teachers will attend their worksite at their own discretion. 3.Monday will be a full day or partial day of student instruction, depending on the decision of the local board and superintendent. In extraordinary and limited circumstances, individual teachers may be permitted at the employer's discretion to work less than a full day, even where the school is working a full day. It is understood, in this context, that time constraints will result in varying levels of difficulty without constituting extraordinary circumstances.

4 How Teachers Are Paid - Teachers under contract (permanent or temporary) are usually paid a yearly salary spread equally out over the 10 month school year (i.e. 10% of their yearly salary per month regardless of the number of days worked) - In many school districts, teachers may also opt to have part of their monthly pay set aside into a savings plan which is paid out to them in the following July and August (resulting in the appearance of 12 month pay) - When teachers work only part of a month, they are deducted pay from the monthly total or paid for only the days worked according to the local version of the CA. There is NO standard language governing how teachers are paid when they work only part of a month (in some cases districts even have multiple variations in language) - BCPSEA has proposed standardization of the language in the CA (including the last round of bargaining) but the BCTF has opposed such changes 4

5 Teacher Pay Example of Teacher being paid $80,000 per year - Gross salary $80,000 per year - Monthly pay = $80,000 / 10 = $8000 per month regardless of days worked ◦[ i.e. $8000 for September (21 days), December (15 days) and March (12 days) ] - When teachers do not work all of the scheduled days in a month, the collective agreement determines how they will be paid for the actual days worked ◦Option 1 - subtract days not worked at a rate of 1/200 th of salary per day ◦Option 2 - pay teachers only for days worked at a rate of 1/200 th of salary per day ◦Option 3 – may be either of, or blending of, the above ◦1/200 th of $80,000 = $400 per day 5

6 Teacher Pay Example of Teacher being paid $80,000 per year Collective Agreement Language: Option 1 – subtract days not worked at a rate of 1/200th of salary per day September, 2014 = 21 working days for a full-time teacher = teachers on strike for 13 days (September 2-18) $8,000 – (13 X $400) = $5200 loss of pay due to strike action $8000 - $5200 = $2800 remaining pay for the month of September 6

7 Teacher Pay Example of Teacher being paid $80,000 per year Collective Agreement Language: Option 2 – pay teachers for days worked at a rate of 1/200th of salary per day September, 2014 = 21 working days for a full-time teacher = teachers on strike for 13 days (September 2-18) = teachers work the remaining 8 days in the month (September 19-30) $400 X 8 days = $3200 pay for the remaining days in the month of September 7

8 Key Facts - Teachers on a full-time or part-time contract are paid a yearly salary (i.e. they are not paid by the day or by the hour) -The considerable differences in CA language which result in teachers being paid differently on a monthly basis have been in place for many years (not just for June and September 2014) -There was no request from the union during the RTWA discussions to vary the CA language in September. Nor was additional funding requested to implement any variation from the CA as part of the RTWA -The union only requested equal pay for all teachers once they received internal complaints as to the differences in pay across districts (cost $5m+) -Teachers continue to be paid differently when they work less than a full month - ALL teachers were paid in full for September 2014 according to the CA. If the BCTF feels differently, there are grievance and arbitration processes available to address their concerns. 8
