2 What is WitEx?  Reviewing statements on a given scenario from both parties and establishing key issues and discrepancies  Establishing your best line of questioning and attempting to make the other witness say exactly what you want them to.  In effect, trying to be Denny Crane.

4 Structure 1. Prosecution Opening – 2 min 2. Prosecution Examination in Chief – 10 min 3. Cross-Examination by Defence – 15 min 4. Defence Opening – 2 min 5. Defence Examination in Chief – 10 min 6. Cross-Examination by Prosecution – 15 min 7. Summation by Defence – 3 min 8. Summation By Prosecution – 3min 9. Judgment

5 Before The Trial  In this time you will be given 90 minutes to search through the problem and highlight relevant legal issues. Once this period is completed, you will be given 30 minutes to consult with your witness. In this period you should:  Outline to the witness how you intend to deal with the case;  How the evidence will be adduced; and  Discuss how the evidence will be put forward to the witness and discuss with that witness what emphasis will be placed on various aspects of it.

7 Who can be my Witness?  Any law student can be your witness  Usually it’s a good idea to try a 1 st or 2 nd year student as they cannot compete themselves but may want an insight into the comp.
