2 Rule Changes

3 6A-6.0901 Definitions Which Apply to Programs for ELLs Kindergarten Roundup -Assess prior to enrollment in KG -Assessment is given no earlier than May 1 of the calendar year the student will enroll Students in Grades 3-12, Reading and Writing - R/W shall be completed as soon as possible after enrollment, but not later than twenty (20) days after the L/S assessment.

4 6A-6.0902 Requirements for Identification, Eligibility, and Programmatic Assessments of ELLs Parental Rights -(d) Parents have the right to have their child immediately removed from a language instruction educational program and to decline to enroll the student in such a program or choose other instructional options, if available.

5 6A-6.0902 Continued Nothing herein shall alter the duty of the district to provide highly qualified, duly certified or endorsed ESOL instructors in accordance with Rule 6A-1.09441, FAC, and the Course Code Directory and Instructional Personnel Assignments that is incorporated by reference therein.

6 6A-6.09021 Annual ELL Assessment for ELLs -LFs on or after September 1, will be assessed on CELLA for that year -Reminder: you must submit Survey 7 for CELLA Pre-Id labels

7 6A-6.090022 Extension of Services in English ESOL Programs -Must have an ELL Committee to extend services -Convened no earlier that 30 school days prior to the third anniversary of the student’s Date Enter United States School (not ELL: Entry Date) -Cannot be after the anniversary date

8 6A-6.090022 Continued -If the anniversary date falls between the CELLA administration and October 1 of the following school year, you may use CELLA and FCAT for your assessment to extend servicers so you will not have to test them again. -This does not mean that you have until October 1 to convene the ELL Committee

9 6A-6.0903 Requirements for Exiting ELLs from the ESOL Program 1. CELLA and FCAT -Grade cluster requirements -K-2 = CELLA only -3-9 = CELLA and level 3 on FCAT Reading -10-12 = CELLA 10 th grade FCAT in Reading sufficient to meet applicable graduation requirements, or an equivalent concordant score pursuant to 1008.22, FS -Must pass all four domains (L, S, R, W) 2. ELL Committee

12 Immigrant Students -The calculation for immigrant counts that will be used for determining eligibility for receiving the Immigrant Grant will used the Date Entered US School as the starting point. -An indicator of whether or not the student meets the definition of Immigrant Children and Youth pursuant to the No Child Left Behind (NCLB) Act, Title III, Part C, General Provisions, Section 3301(6) at anytime during the school year.

13 Immigrant Students Continued -The term immigrant children and youth means individuals who: -(A) are ages 3 through 21;and -(B) were not born in any State, the District of Columbia or Puerto Rico; and -(C) have not been attending one or more schools in any one or more States for more than 3 full academic years. -Remember to change the immigrant status to “N” after the student has been attending any US school more than 3 full academic years. Note: The children of U.S. military personnel born overseas are to be included in any count of immigrant children or youth.

14 Immigrant Students Continued Per a letter that was sent to all Title III Directors, Jan. 13, 2011, from USDE: “LEAs would need to track the amount of time that a child has attended school in the same district, other districts or states, if applicable, in prior years in order to determine if a child’s period of attendance is within the “three full academic years” requirement.”

15 Student ELL Plan -Must reflect current services. -Update ELL: Student Plan Date The date of the most recent development or review of the English Language Learner Student Plan.

16 Electronic Student ELL Plan -Electronic Template for Student ELL Plan is being created -If districts that have an electronic Student ELL Plan and would like to share it with DOE, please email a copy to Pat Faircloth, at pat.faircloth@fldoe.org. pat.faircloth@fldoe.org

17 Survey Dates Survey 2 -Survey Week: October 8 - 12, 2012 -Due Date: October 26, 2012 -State Processing: October 15 - November 9, 2012 Survey 7 -Due Date: January 3, 2013 -State processing: December 10, 2012 - January 9, 2013

18 Available Reports F70803 – ELL by Code by School – a count of students by status codes by school. This count includes all codes. F70897 – ELL by Native Language – a count of students by native languages. F70898 – ELL by Country Code – a count of students by country of birth.

19 Available Reports F70908 – ELL by Category –a count of students by status codes by school. This does not include code LZ or ZZ. F70910 – ELL Comparison Report – a comparison of ELL counts by current year and previous year. (LY and LP)

20 Available Reports Error Reports for Surveys 2 & 3 F70919 - ELL Error Report – also creates reports F71234/F71235 F70919 (Code LY) and F71234 (Code LF) Counts of students in certain areas of common reporting problems by Student ID’s. F71235 (LY and LF with No Matching ELL Record by Student ID’s)
