3 { Family Smoking Prevention and Tobacco Control Act of 2009 give local governments the authority to control such products. Concern: New un-regulated nicotine products entering market have packaging and product design, flavoring, and bold advertising that immolate products designed for youth.

4 { Determining Current Belief Informal surveys indicated discovered the perception that smokeless tobacco products were better for you because they do not have “smoke” associated with them. Modified Risk Majority of people believe “smoke” is the harmful substance. Local health officials and Health Providers are concerned products threaten the current low tobacco use statistics. If its so bad the FDA will take care of it - Slow FDA response to the products

5  Two education campaigns designed to target  Youth (middle school through early high school)  Policy makers  Youth campaign consisted of social media, viral messages, and guerilla marketing Don’t Start with Me Facebook Mr. Tobacco You Tube  One on one meetings with policy makers using real materials, scientific evidence, Health Providers concerns, and health care costs statistics associated with current tobacco use and its impact on the economy. 7  Local education of children is the number one priority. Crafted messages that tie in to underage tobacco use. For example, “Kids who do better in school are less likely to use tobacco.”  Do not use “Big Tobacco” in messaging. Officials are not open to this negative connotation. Regulations are meant to protect children, not to keep tobacco companies from doing business. Keep messaging on the protection of children - safety and education messages work better with elected officials  Instead of saying the products look like candy use “candy like appearances”  Try avoiding using the word tobacco. Use “nicotine products”, “products containing nicotine extract”  Put together fact sheets explaining the difference  If you have costs analysis, use them Tips on Developing a Message

8  Worked with County Attorney and Tobacco Control Legal Consortium to draft a policy based on feedback from policy makers.  Kept advocates informed on education efforts;  American Cancer Society  American Academy of Pediatrics  Society of Public Health Officials  American Lung Association  Presented draft to policy makers in more one on one meetings  Make sure stakeholders and Advocates present the document.  Presented policy to Board of Health to present to the Board of County Supervisors.  Ordinance was passed February, 2012. 9  Any retailer selling unregulated nicotine products must obtain a tobacco sales permit from their city clerk.  It is prohibited to sell un-regulated nicotine products to minors.  Added May 2012 – Sales of un-regulated nicotine products require sales clerk intervention. Nicotine Ordinance Key Points

10  Tobacco Outlet Retailers Association were against initially but became an advocate once they realized anyone could sell un-regulated nicotine products.  Local Tea Party Chapter argued freedom of choice and big government.  One local tobacco retailer argued against the section requiring sales clerk intervention. Opposition

11  One violation of permit letter issued. Establishment is now in compliance  One violation of product placement.  Local bars and restaurants are not selling products because of added responsibility. Current Status
