What is PPS’ Civil Rights Policy? Portland Public Schools recognizes the diversity and worth of all individuals and groups and their roles in society. All individuals and groups shall be treated with fairness in all activities, programs, and operations without regard to age, color, creed, disability, marital status, national origin, race, religion, sex or sexual orientation. This standard applies to all District Policies and Regulations. This policy (1.80.020) is available on the district web site: http://www.pps.k12.or.us/directives-c/pol-reg/1/80/020_P.pdf

Why do we review Civil Rights each year? All Nutrition Services employees and PPS employees must follow USDA (federal), ODE (state) and PPS (local) regulations on nondiscrimination while providing child nutrition program services.

No person can be denied program benefits based on Race, Color, National Origin (Title VI and VII of the Civil Rights Act, 1964) Sex/Gender (Title IX of the Education Amendments, 1972) Age (Age Discrimination Act, 1975) Disability/Handicap (Section 504 of the rehabilitation Act, 1973) (Americans with Disabilities Act, 1990)

Denied benefits - exclusion of eligible persons based on race, color, national origin, age, sex, or disability Different service - inequitable service or allocation of food based on the above Delayed benefits Segregation of persons by the way they are scheduled Failure to apply the same eligibility criteria to all potentially eligible persons What are examples of discrimination?

Who has the right to file a Civil Rights complaint? Any person alleging discrimination on the basis of race, color, national origin, sex/gender, age or handicap/ disability can file a complaint.

What is the procedure for filing a Civil Rights Complaint? What Information is needed? Complainant’s –Name –Address –Telephone number Location where discrimination occurred Nature of the incident Basis for the claim-race, age, disability, etc Names of witnesses Dates when action(s) occurred Note: all of these are included on the ODE complaint form – see next slide…

Where should the “Justice for All “ Non-Discrimination Poster be displayed? The “Justice for All “ poster MUST be displayed in a prominent place which is visible to meal program participants. (ODE May 2008 version)

Where can we find the USDA Non-Discrimination Statement? All printed materials must contain the non-discrimination statement that no person will be denied program benefits on the grounds of race, color, national origin, sex, age or disability.

Example of the USDA Non-Discrimination Statement found on the K-5, K-8 Menu Calendar and the “Justice for All” Poster In accordance with Federal law and U.S. Department of Agriculture policy, this institution is prohibited from discrimination on the basis of race, color, national origin, sex, age or disability. To file a complaint of discrimination, write USDA, Director, Office of Civil Rights, 1400 Independence Ave, SW, Washington, D.C. 20250-9410, or call, toll free (866) 632-9992 (Voice). TDD users can contact USDA through local relay or the Federal relay at (800) 877- 8339 (TDD) or (866) 377-8642 (relay voice users). USDA, the State of Oregon and Portland Public Schools are equal opportunity providers and employers.

Example of the Shorter USDA Nondiscrimination Statement Federal regulations allow use of a shorter nondiscrimination statement on program material less than one page in length; i.e. brochures, coupons, menus, and flyers. The short statement must be in the same size print as the text of the document. This institution is an equal opportunity provider. USDA, the State of Oregon and Portland Public Schools are equal opportunity providers.
