2  Provider Manual Section 5.10. Provider Subcontracts: An approved subcontract is required when any part or requirement of a service as defined by the service definition and provider agreement is to be rendered by individuals who are not directly employed (either as paid or volunteer staff) by the provider. The provider must hold any subcontractor(s) to the same terms and conditions specified in the DIDD provider agreement. Providers relying upon subcontracted persons or entities for the provision of services are fully responsible for any services provided by or with the assistance of the subcontractor. Provider subcontracts are to be submitted to the DIDD Central Office for approval and are subject to TennCare approval. Services shall not be provided until approval is received.

3  DIDD approved Providers can request a subcontract packet (subcontract form, cover letter with instructions, disclosure forms, and a check list of items to be returned)via email from Julia.Jinnette@tn.govJulia.Jinnette@tn.gov  Complete packet, secure signatures and email to Julia.Jinnette@tn.gov Julia.Jinnette@tn.gov  or mail to: Attn: Julia Jinnette, Contract Services State of TN/Dept of Intellectual and Developmental Disabilities Citizens Plaza, 9 th Floor 400 Deaderick Street Nashville, TN 37243  Include Copy of current license, proof of insurance, fingerprint/background investigation results of Subcontractor.

4  DIDD will audit and make recommendations to Commissioner for approval or denial.  Approval/Denial Letter from Commissioner is emailed to Provider.  Provider shall keep all pertinent subcontract documentation on file for audit purposes.  Provider shall notify DIDD Contract Services any cancellations of subcontracts.

5  A Provider uses the Subcontract for an individual or agency who is performing, for the Provider, services that are listed on the Provider’s Agreement under Section A.2.: Approved Services
