2 Human Rights Act Coverage Covers Employers (w/1 employee), State Agencies, Employment Agencies, Labor Organizations Not Federal Government or Post Office Protected Groups include race, sex, religion, sexual orientation, national origin, age, and disability (among others)

3 Human Rights Act Requirements Equal Opportunity in hiring, promotions, training, discipline/discharge, conditions of employment (among other things) Protection from Harassment Reasonable accommodation for applicants and employees (individual should request as needed)

4 Reasonable Accommodation (continued) For applicants, accommodation can mean modifications to testing/interviewing procedures For employees, accommodation can mean modification to work site, work schedule, work procedures, adaptive equipment, readers and interpreters

5 Discrimination Charges Person who has been discriminated against in employment has the right to file a charge within 180 days with the Department of Human Rights and 300 days with the U.S. Equal Employment Opportunity Commission Relief for discrimination includes reinstatement, back pay, whatever was lost due to the discrimination

6 Human Rights Act and State Employment Section 2-105 (B) Affirmative Action in Hiring/Promoting African Americans, Hispanics, Women, Asians, American Indians, Native Hawaiians and People with Disabilities State Agencies examine their workforce, determine if 4.4% is People with Disabilities, and if not, set goals

7 Compliance Activities Agencies with disability underutilization recruit and report quarterly on hires of people with disabilities Agencies have internal complaint procedures DHR monitors the hires/promotions/layoffs of people with disabilities (among other groups) As of 9/30/12, 3,305 (7.28%) have disabilities

8 ICED Mission is to enhance access and opportunities for employees with disabilities in state government Bi-monthly meetings open to the public Activities include educational programming, awards program, internship program, advocacy Remember: ICED wants you to work for state government.
