217 CFR Pages published 12/24/13 in Federal Register Effective date of the Final Rule-March 24, 2014 Other than security (1/1/14) and tankerman (3/24/14), Jan 1, 2017 is next compliance date for existing mariners Appears to be a fair and balanced final rule (could have been worse!) CFR’s only provide the outline for compliance 26 USCG NVIC’s provide the detailed guidance for compliance and enforcement of CFR’s. Subpart C (g)- NVIC Grandfathering & Transition Summary-Existing mariners as of 3/24/14 If training or approved sea service started on or after 3/24/14 or applying after 1/1/ MUST adhere to the new rules. Anyone with an STCW issued before 3/24/14 only needs to complete GAP Closing requirements prior to 1/1/17. Anyone who applies for a credential based on approved or accepted training or approved seagoing service that was completed before March 24, 2014, can qualify based upon existing regulations. This provision allows renewal and upgrade based on regs prior to final rule Limitation of expiration 12/31/16 will be issued Additional Gap Closing requirements must be completed and submitted to remove limitation Anyone with an Operational-level STCW (Deck/Eng) issued prior to March 24, 2014 who upgrades to an STCW management-level endorsement will not be required to redo any operational assessments. Coast Guard will continue to issue STCW endorsements meeting the requirements of existing regs before March 24, 2014, for seafarers with service that began before March 24, 2014, until January 1, 2017. 6 Overview of Training issues relative to AMO/STAR
Security Training required by 1/1/2014- Membership awareness/compliance issues prior to effective date caused issues for STAR (Can’t happen with gap closing!) Tankerman regulations (new entrants) effective 3/24/14 Anyone with an existing USCG Tankerman Endorsement is grandfathered in under the new regs Existing Mariners can renew credentials based upon current regs (1 year of sea time only) until 12/31/16 All other STCW training requirements (Gap Closing)-Must be in full compliance on or after 1/1/2017 STAR as the primary training provider to the men and women of AMO is impacted by this rule making more than any other training organization Delay in Final Rule and the publishing of the NVIC’s has reduced time for compliance creating considerable hardship STAR Center Simulation Training Assessment & Research

Priorities for STAR STCW Implementation Plan GAP Closing Requirements- Training all STCW Officers must complete by 1/1/2017 Renewal Requirements- Training to renew a credential or endorsement on or after 1/1/2017 Upgrade Requirements- Training to upgrade from operational to management credential on or after 1/1/2017 (Note: while upgrade after 1/1/2017 is not specifically addressed here in, there is guidance on transitioning and for those upgrading and being assessed before 1/1/2017 in this presentation.) STAR/AMO STCW GAP Closing Plan Understanding Requirements and Compliance Dates Planning and Scheduling Gap Training Note: STARCenter has released all 2014 and 2015 gap closing course schedules. Completing Required Gap Closing Training Credential Compliance-remove limitations Submitting training to USCG to remove expiration limitation prior to 1/1/2017 Receive new sticker from USCG for MMC with new expiration out to the full 5 year validity of the credential All involved have specific responsibilities in the structured process Don’t wait until 2016! III/2 ERM if not completed at the operational level Management of Electrical and Electronic Control equipment OICNW (3/M & 2/M) STCW reg. II/1 Evidence of meeting the standard of competence in Leadership and Team Working Skills ECDIS, if serving on a vessel with this equipment. OICEW (3AE & 2AE) STCW reg. Deck STAR Advanced BRM is approved as meeting new Leadership and Management requirements (Different than regular and upgrade BRM) Leadership and Management Course (5 days)- Nov 2014 Classroom Leadership and Team Working Skills (1 day) STAR ECDIS Course approved (even if taken in the past)- USCG ECDIS Bulletin STAR is requesting addition grandfather credit from USCG Engine STAR ERM approved- (5 days) ALSO meets OICEW Leadership and Team Working Skills Requirement! Classroom Leadership and Team Working Skill (1 day) 2015 (Not needed if taking ERM) Management of Electrical and Electronic Control Equipment (5 days)- Nov 2014 STAR Center Simulation Training Assessment & Research

11 Renewal Requirements Summary- First Renewal on/after 1/1/17
You can renew credentials based upon previous regulations until 1/1/2017 The additional training below is not required by USCG until your FIRST RENEWAL AFTER 1/1/2017 Every 5 years seafarers qualified in accordance with…..must provide evidence of maintaining the standard of competence for …….. Basic Training (NVIC 08-14/03-14) STCW Reg VI/1 Revalidation of Basic Training-1 day course (WITH 1 year sea time) Refresher of Basic Training- 3 day (WITHOUT 1 year sea time) Advanced Firefighting (NVIC 02-14/03-14/09-14) STCW Reg. VI/3 Revalidation of Advanced FF-1 day course (WITH 1 year sea time) Refresher of Advanced FF-2 day (WITHOUT 1 year sea time) Proficiency in Survival Craft (NVIC 02-14/04-14) STCW Reg. VI/2 With 1 year of sea time no additional requirements other than Basic Training Without 1 year sea time- complete original PSC course Fast Rescue Boat (NVIC 02-14/05-14) STCW Reg. 12 New Upgrade Requirements Transition
Existing mariners can continue to use previous regulations and transitioning provisions to upgrade to the Management Level until 12/31/16 Mariners upgrading in this way must complete the mgt level gap closing requirements by 1/1/2017 STAR is currently evaluating new NVIC’s to determine future upgrade program requirements for those who started sea service and training after 3/24/14 or who will be upgrading after 12/31/16 Deck or Engine upgrades Between now and 12/31/16 you can upgrade based upon previous requirements but must meet the additional gap closing requirements by 12/31/16 Assessments (NVIC provides details) If required by previous regs (in effect as of 3/24/14) they must be submitted For areas where no assessments were published prior to 3/24/14, the new assessments will be required starting 6 months after guidance and model assessments for the particular endorsement are published STAR Center Simulation Training Assessment & Research

13 New Upgrade Requirements Transition
USCG Qualified Assessor Program A Qualified Assessor (QA) is a person that the Coast Guard deems qualified to evaluate whether an applicant has demonstrated the necessary level of competence in the task for which the assessment is being made. A QA must be approved by the Coast Guard either individually or as part of a Coast Guard approved or accepted course or training program. As noted in NVIC (Grandfathering and Transitional Provisions for Merchant Mariner Credentials, Enclosure (2)), the Coast Guard will accept STCW assessments that have been performed and signed by an assessor who has not been Coast Guard approved until December 31, 2016, provided that the assessor meets the professional requirements in 46 CFR (a)(3) to assess competence for the specific endorsement.
