8 PRC Framework Document
Overarching Goals Develop science-based recommendations Protect public health and the environment Provide a regulatory path for potable reuse projects in Florida

9 Approach PCR Framework guidance from Water Research Foundation
Internationally recognized Non-profit research organization – credible and scientific The Water Research Foundation has extensive experienced in potable reuse technical/scientific research WRF lead 3 one-day interactive workshops Provide opportunities for stakeholder to present questions or concerns. Approach: Workshop #1: Recommended a list of topics and options Workshop #2: Summarized recommendations based on stakeholder input and current state-of-science. Workshop #3: Review comments on Draft Report of recommendations.

10 Framework Development Open Process - Public Involvement
Publicly Noticed 18 Meetings in Florida Administrative Register (FAR) Hosted 3 Workshops Over 150 Attendees 30 Organizations 30 State & National Presentations

11 to develop the framework doucment
Approach to develop the framework doucment Identify initial topics Collect input at stakeholder workshops Develop a public review draft Guidance Doucment Finalize Guidance Document report for PRC

12 Florida Specific PR Guidance Document Outline
Part 3 – Florida Potable Reuse Regulatory Framework Chapter 9 – Overview of Regulatory Framework Chapter 10 – Regulatory Changes the PRC Recommends to Promote Potable Reuse While Protecting Public Health and the Environment Appendices References Useful Resources for Potable Reuse Summary of the Water Research Foundation Potable Reuse Research Efforts

13 Florida Potable Reuse Commission
SPECIFIC REGULATORY PROPOSED RECOMMENDATIONS

14 Proposed Florida Recommendations
Drinking Water Related Regulations Include all potable reuse requirements in rules addressing drinking water by moving existing potable reuse specific requirements to drinking water related regulations New legislation directing FDEP to adopt new potable reuse rules Broad stakeholder technical advisory committee assists FDEP Source Water/Pathogens Include reclaimed water as source water and address pathogens removal or inactivation in reclaimed water for potable reuse New legislation directing FDEP to adopt new rules for pathogen treatment in potable reuse

15 Proposed Florida Recommendations (cont.)
Emerging Constituents Address emerging constituents in potable reuse by employing appropriate treatment technology and adding representative emerging constituent to existing environmental monitoring protocol New legislation directing FDEP to adopt rules implementing PRC emerging constituents approach Broad stakeholder technical advisory committee assists FDEP Reclaimed Water Recharge FDEP reviews existing recharge rules in parallel with new rules for potable reuse

16 Proposed Florida Recommendations (cont.)
Industrial Pretreatment Extend industrial pretreatment requirements to potable reuse FDEP amends rules to require wastewater utility to develop source control program for sources utilities identify as needed Broad stakeholder technical advisory committee assists FDEP “Off-Spec” Reclaimed Water Address “off-spec” reclaimed water through alternative disposal, retreatment, or non-potable reuse FDEP would promulgate new “off-spec” rules for potable reused

17 Proposed Florida Recommendations (cont.)
Drinking Water Standards Compliance Compliance with drinking water quality standards at point where finished water finally discharged from DWTF to distribution system New legislation specifies drinking water point of compliance and directing FDEP to adopt rules Broad stakeholder technical advisory committee assists FDEP Water Use Permit for DPR Ensure existing law that no water use permit needed for a DPR remains unchanged as potable reuse statutes and rules are adopted

18 Proposed Florida Recommendations (cont.)
Protecting Springs Ensure existing spring protections continue FDEP to amend rule to clarify that IPR reclaimed water released to groundwater moving to springs complies with surface water quality standards (if necessary as other rules are amended) with support of technical advisory committee Existing Regulations Review FDEP reviews reclaimed water treatment, groundwater recharge, and potable water treatment, and updates regulations as necessary with support of technical advisory committee

19 Proposed Florida Recommendations (cont.)
IPR Definition Include groundwater recharge in IPR definition Broad stakeholder technical advisory committee assists FDEP Coordination MOU DEP and WMDs to enter into MOU providing for coordinated review of all potable reuse permits if applicant so requests Incentivizing & Protecting Public Investment in Potable Reuse Form working group to determine if changes needed to existing law to incentivize and protect public investments in potable reuse projects Not FDEP technical advisory committee

20 Move Potable Reuse from Ch. 62-610 to Drinking Water Regulations
Proposal - move potable reuse specific requirements from Ch , F.A.C., to drinking water related regulations – e.g. Chs , , & Include new potable reuse requirements in drinking water regulations. Goal – include all potable reuse requirements in rules addressing drinking water Implementation – New legislation directing FDEP to adopt new potable reuse rules following this approach FDEP then adopts rules based on legislation Technical advisory committee consisting of broad stakeholder group assists FDEP in rulemaking

21 Review of Rules Governing Reclaimed Water Groundwater Recharge
Proposal - FDEP reviews existing Ch , F.A.C., groundwater recharge requirements in parallel with new rules for potable reuse Implementation - Technical Advisory Committee consisting of broad stakeholder group assists FDEP in rule review

22 Addressing Pathogens in Reclaimed Water for Potable Reuse
Proposal - Change regulations to consider reclaimed water as source water when requiring removal or inactivation of pathogens Public water system engineering report would use source water characterization to determine approach for achieving pathogen log reduction targets Require utilities to establish treatment level & multiple barriers ensuring pathogen removal or inactivation sufficient provide risk of infection below 10-4 annually. Implementation – Enact new legislation directing FDEP to adopt new rules for pathogen treatment in potable reuse. FDEP then adopts new rules based on legislation. Technical advisory committee assists FDEP in developing new rules
