6 NDAA FY17 Provisions – Training Required
Sec 832 – Contractor Incentives To Achieve Savings And Improve Mission Performance. ACTION REQUIRED: Develop and implement a training programs for acquisition personnel. Requires the Defense Acquisition University to provide training on the use of contracting authorities that incentivize contractors to deliver additional savings to the government. DEADLINE FOR ACTION REQUIRED: 180 Days After Enactment DESIGNEE FOR ACTION REQUIRED: DAU PRIMARY OSD ACTION OFFICE: AT&L AT&L OFFICE: DAU/DPAP WHAT DOES DONE MEAN? Ongoing. This is a continuous process improvement effort. DAU has already updated various contracting courses in both its classroom courses and training modules and will continue to do so to remain current with the latest Department policies and initiatives. Sec 898 – Establishment Of Panel On Department Of Defense And AbilityOne Contracting Oversight, Accountability, And Integrity; Defense Acquisition University Training. Requires Panel to review the effectiveness and internal controls of the AbilityOne Program related to DoD contracts, to ensure DoD funds are expended appropriately under the Program, and to recommend ways to eliminate waste, fraud and abuse; Requires DoD to establish an AbilityOne Program training at DAU. Progress Report: NLT 180 days after enactment. (06/21/2017) Annual Report: NLT September 30, 2017 and annually for next 3 years; see specified Committees & entities. 7 NDAA FY17 Provisions – Training Required
Not in Provision… from Committee Report ACTION REQUIRED: ...The Secretary of Defense, acting through the Under Secretary of Defense for Acquisition, Technology, and Logistics, shall conduct a review of the curriculum taught at the National Defense University, the Defense Acquisition University, and appropriate private-sector academic institutions to determine the extent to which the curricula includes appropriate courses on data analytics and other evaluation related methods and their application to defense acquisitions, and how these efforts can be used by the acquisition workforce to perform their missions. The conferees direct the Secretary of Defense, not later than 1 year after the date of the enactment of this Act, to brief the Armed Services Committees of the Senate and House of Representatives on the use of data analysis, measurement, and other evaluation-related methods in DOD acquisition programs. The briefing shall address...an assessment of whether the curriculum at the National Defense University, the Defense Acquisition University, and appropriate private-sector academic institutions includes appropriate courses on data analytics and other evaluation-related methods and their application to defense acquisitions. DEADLINE FOR ACTION REQUIRED: NLT one year after enactment DESIGNEE FOR ACTION REQUIRED: AT&L lead is TBD. DAU only has a portion of this and we have told ASD(A) we should not be lead but will support.

8 NDAA FY17 Provisions – Resources Demanded
Sec 824 – Treatment Of Independent Research And Development Costs On Certain Contracts. ACTION REQUIRED: SECDEF shall prescribe regulations governing the payment by the DoD expenses incurred by contractors for IR&D. Such regulations shall provide that expenses incurred for IR&D shall be reported independently from other allowable indirect costs. If the Department of Defense exceeds the goal (by more than 1%) for a fiscal year, establish Panel within 180 days after exceeding the goal. Note: Establish Panel (SD) and provide Administrative Support to the Panel (DAU/NDU) DEADLINE FOR ACTION REQUIRED: 10/1/ Report on bid and proposal costs and independent research and development costs as part of the report required under 2313a of title 10, United States Code. Interim report due 6 months after panel is established, Final report 1 year after Panel is established. AT&L OFFICE: DPAP Sec 863 – Purposes For Which The Department Of Defense Acquisition Workforce Development Fund May Be Used; Advisory Panel Amendments. Amendment clarifies that the advisory panel on streamlining and codifying acquisition regulations that was established in section 809 of the National Defense Authorization Act for Fiscal Year 2016 (Public Law ) is an independent advisory panel to be supported by the Defense Acquisition University and the National Defense University. The amendment would further clarify that, as an independent advisory panel, the panel has the hiring authorities provided in section 3161 of title 5, United States Code. The amendment also would limit the amount of funds that may be used in fiscal year 2017 for acquisition tools and methodologies and the undertaking of research and development to $35.0 million. PRIMARY OSD ACTION OFFICE: AT&L AT&L OFFICE: DAU/DPAP WHAT DOES DONE MEAN? Part (d) is completed. DAU has used this authority to hire additional support to the Panel and they are now on board and fully supporting it.

9 NDAA FY17 Provisions – Other
Sec 866 – Senior Military Acquisition Advisors In The Defense Acquisition Corps. ACTION REQUIRED: Adds a new section 1725 to title 10, United States Code, to authorize the Secretary of Defense to establish in the Defense Acquisition Corps positions to be known as "Senior Military Acquisition Advisors". Senior Military Acquisition Advisors would be appointed by the President, by and with the advice and consent of the Senate. Eligible officers include officers in the grade of colonel or captain in the Navy, with extensive defense acquisition experience, and who are eligible for retirement. Senior Military Acquisition Advisors would be authorized to remain in service in support of their Service Acquisition Executive and be assigned as an adjunct professor at the Defense Acquisition University. Senior Military Acquisition Advisors would be competitively selected and would provide senior level acquisition expertise to the Service Acquisition Executive of their military department for the remainder of their career. An officer who is continued on active duty under this program is not eligible for consideration for selection for promotion. A Senior Military Acquisition Advisor will serve no longer than a 5-year term. When a Senior Military Acquisition Advisor retires with a minimum of 3 years of service, the officer may, at the discretion of the President, be retired as a brigadier general or rear admiral (lower half), but without increase in retired pay or other compensation by reason of retirement of an officer in the grade of brigadier general or rear admiral (lower half). AT&L OFFICE: SAEs Sec 214 – Authorization For National Defense University And Defense Acquisition University To Enter Into Cooperative Research And Development Agreements. (a) NATIONAL DEFENSE UNIVERSITY.—Section 2165 of title 10, United States Code, is amended by adding at the end the following new subsection “(f) COOPERATIVE RESEARCH AND DEVELOPMENT AGREEMENTS.” (b) DEFENSE ACQUISITION UNIVERSITY.—Section 1746 of title 10, United States Code, is amended by adding at the end the following new subsection “(d) COOPERATIVE RESEARCH AND DEVELOPMENT AGREEMENTS.” PRIMARY OSD ACTION OFFICE: AT&L AT&L OFFICE: DAU WHAT DOES DONE MEAN? This is ongoing. Provision does not require a specific product or action but rather grants authorization to pursue agreements to improve education and training efforts.
