2 FERPA – Family Educational Rights and Privacy Act
Defines educational records as all records that schools maintain about a student. Gives parents the right to review and confirm the accuracy of education records. 3 What is not part of a student’s education record?
Personal notes made by teachers and other school officials that are not shared with others. Law enforcement records created and maintained by a district’s school resource officer. FERPA’s provisions do not apply to grades and educational decisions about children that school personnel make.

4 HIPAA – Health Insurance Portability and Accountability Act of 1996
Gives parents more control over health information Sets boundaries on the use and release of health records. Limits release of information to the minimum reasonably needed for the purpose of the disclosure.

5 FERPA and HIPAA Protect the Confidentiality Rights of Students
Obtain written consent before giving out any identifiable information about a student. Do not give out information that is protected by FERPA or HIPAA
