2 Construction General Permit - TXR150000
Authorizes the discharge of stormwater runoff associated with small and large construction sites and certain non-stormwater discharges into surface water in the state. Effective March 5, 2018 - CGP expires five years from the permit effective date All active authorizations expire on the same date the general permit expires

4 Construction Activity
What is Construction? Clearing Grading Excavating, or Similar activities that disturb / expose soil Demolition, infilling pits, and stockpiling soil for construction What is not Construction? Certain routine maintenance activities Routine grading of roads Asphalt overlay of roads Routine clearing of ROW Agricultural land disturbance Demolition Linear Projects

7 Operators – Large Construction
PRIMARY operational control over construction plans and specifications – including ability to make changes OR day-to-day operational control of activities – authorized to direct workers at site to carry out activities to comply with permit conditions

10 CGP and Municipalities
If discharging to gutters, streets, channels, ditches or any other Municipal Separate Storm Water Sewer System (MS4) – operators must submit a copy of each of these forms to the MS4 operator   NOI NOC NOT A Notice of Change is required to be submitted for making updates, changes, or corrections to an NOI or Waiver as required in the general permit.

11 Small Construction Sites Activities
disturb an acre or more but less than five Permit Requirements: -preparation & implementation of SWP3 -small construction site notice -notify MS4 operator Not required to submit: -Notice of Intent -Notice of Termination

12 Disturb less than an Acre
If the project site disturbs less than 1 acre and is not part of a larger common plan of development, coverage under the general permit is not required. Requirements: -implementation & maintenance of best manageable practices - notify MS4 operator

13 Terminating Coverage The NOT must be submitted to TCEQ, and a copy of the NOT provided to the operator of any MS4 receiving the discharge , within 30 days after any of the following conditions are met: final stabilization has been achieved on all portions of the site that are the responsibility of the operator; b) a transfer of operational control has occurred; or c) the operator has obtained alternative authorization under an individual TPDES permit.

14 Terminating Coverage Final stabilization must be achieved prior to termination of permit coverage. All soil disturbing activities at the site have been completed and a uniform perennial vegetative cover with a density of at least 70% of the native background vegetative cover This does not include areas with permanent structures Large & Small Construction Operators must : Remove temporary Best Management Practices Remove site Notice(s) Small Constructions sites do not need an NOT. that is, evenly distributed, without large bare areas

15 Oil and Gas Activities & Construction
The CGP does not authorize discharges from construction activities associated with the: exploration, development, or production of oil or gas or geothermal resources including construction associated with the transportation of crude oil or natural gas by pipeline. Operators of these construction activities may need to obtain permit coverage from the U.S. EPA and the Texas Railroad Commission If the Construction activity is associated with the production or exploration of oil and gas, the project may be under the jurisdiction of the Texas Railroad Commission  and you may need authorization under the National Pollution Discharge Elimination System program  These discharges are not under the authority of the TCEQ. If coverage is required, operators of these construction activities may need to obtain permit coverage from the U.S. EPA and the Texas Railroad Commission

Applications must be submitted using the State of Texas Electronic Reporting System (STEERS) at: Electronic filing is available for the following: -Notice of Intent -Notice of Termination -Notice of Chance -Low Rainfall Erosivity Waiver

Concrete Truck Washout - For Stormwater runoff from the concrete batch plants Revised the benchmark monitoring level for Total Suspended Solids (TSS) from 100 milligrams per Liter (mg/L) to 50 mg/l. - Added clarification that posted small construction site notices may have a redacted signature if there is an original signed and certified copy of a site located at the site. - Added clarification in the impaired waterbodies section that references the CWA 303 (d) List and the Texas Integrated Report.
