1 Mandate and proposal for working methods
Expert Group Priority Substances Brussels, September 2009 Jorge Rodriguez Romero WFD Team Coordinator DG Environment, European Commission

2 Mandate agreed by the WG E in July
Concluding the EQS guidance, taking into account the testing that INERIS is going to do on a number of substances Conclude the modelling-based prioritisation Review the results of the monitoring-based approach developed by INERIS, in particular as regards quality and representativeness of the monitoring data used Review the list of candidate substances as per Annex 1 to this paper, in order to report to the Working Group whether the available evidence shows that the candidate substance should be included on the list of priority substances as PS or PHS and, if this is the case, whether the substance should be regulated through EQS for water, sediment and/or biota, and the proposals for such EQS. This presentation will cover points 2 to 4

3 Prioritisation principles Art 16 WFD
Significant risk to or via aquatic environment, including to surface waters used for drinking water Identification of risks through Risk assessments under chemicals, pesticides or biocides legislation Targeted risk assessment focusing only on toxicity to or via aquatic environment Simplified risk-based assessment procedure based on scientific principles and taking into account intrinsic hazard monitoring data production volumes and/or use patterns.

4 Overall approach to prioritisation

5 Starting point: candidate list
3 Simplified RA PHS criteria Art 8 EQSD Additional information 1 RARs 1-2

6 Proposed steps Finalise modelling-based approach and fill in the information in list of candidate substances Agenda point 6 Agree screening criteria to shrink the list from ~300 to a manageable number (30-50?) Agenda point 5 Prepare dossiers for all substances remaining on the candidate list, to be used as a basis for substance specific discussions Agenda point 4 Finalise EQS derivation for those substances selected Each step overlooked by WGE

7 Contents of the dossiers
Risk assessment reports, if available If monitoring data available, fact sheet of the monitoring database (as in If ranking high in the monitoring-based approach: Results of the a posteriori checking made by INERIS Additional information and checkings as per proposed in agenda point 4 Data sheet filled in as proposed in agenda point 4 (although for the first stage discussions the section on EQS will be empty) Any other additional information brought by COM, MS or stakeholders

8 Questions to the Expert Group
(Timetable > proposed to be discussed by the end of the day) Do you agree with the approach? Who prepares the dossiers (including the eventual EQS derivation): COM consultant and MS (with information provided by stakeholders) To propose additions to the list of candidate substances the agreed datasheet template can be used A deadline should be established to propose additions of new substances to the list of candidate substances
