Towards a solution At the central level of a MoJ or a Council for the Judiciary, policymakers want to know how courts perform. Important changes in judicial organisation have nothing to do with measured performances. (e.g. judicial map) How to make independent judges perform? How to make court organisations perform? 11 Multilevel performance measurement of judiciaries

12 Problem: national performance data are measured differently
Numbers suggest calculations are possible mean, averages, timeliness in days, number of judges and so on Each country uses separate definitions of standards and measurement. In some countries measurement differs from court to court Example: when should you start counting with the time it takes to decide a case? Date of filing at the court Reception date of the filing letter Poststamp date of the filing letter Registration of the case after check of court competence Idem for the end time: Date of the judgement Experiy date for filing appeal at a higher court Date the judgement was sent to the parties National data therefore cannot be compared with data from other countries, other than at an indicative level 28 oktober 2019 Montaigne Centrum voor Rechtspleging en Conflictoplossing
