1 IR35 and other employment issues

2 Overview of IR35 Applies to working through an intermediary. Often your own company but could be a partnership or other person. Not many teachers affected but will apply to interim consultants etc. Need to establish if off-payroll working rules apply.

3 Off payroll rules For public services it’s the authority who is responsible for deciding. For private it is the provider. If they apply then tax and NI should be deducted and reported to HMRC.

4 What are the effects on music education of an increase in self employed teachers. When is it appropriate? The result of recent guidance set alongside budget pressures had resulted in particularly risk adverse employers opting to use more self employed teachers.

5 What to be aware of. Substitution. – who chooses cover teachers and how are they paid. Control – Timetables, reports, lesson observations. Complaints – compliance or control. Facilities charge

6 What does this mean for the sector.
Training and career development – if this is becoming the responsibility of the music educator how do we support access to CPD. Helping schools / parents make an informed choice. Zero hours contracts / full or part time New skills for leaders / managers and where are the next generation of leaders?
