Stat promulgated after report published 2014 – Committee for Equality and Justice (CEJ) recommended study of pretrial risk assessments Minnesota Judicial Branch (MJB) Strategic Plans FY14-15: Priority 3.B.ii: “Study evidence-based tool(s) for use in making pretrial release decisions statewide.” FY16-17: Priority 3.A.ii: “Continue study of evidence-based tool(s) for use in making pretrial release decisions statewide.” 6/19/2019

4 Legal authority Minn. Stat. § “The local corrections department or its designee shall conduct a pretrial bail evaluation of each defendant arrested and detained for committing a crime of violence as defined in [listed statutes] The Judicial Council, in consultation with the Department of Corrections, shall approve the pretrial evaluation form to be used in each county.” Minn. Stat. § § , subd. 1(a); , subd. 2(a) When a person is arrested for a crime against the person or certain stalking or domestic-abuse related crimes, the judge before whom the arrested person is taken shall review the facts of the arrest and detention. 6/19/2019

When doing the transfer: Only run file in CSTS. Do not run the transfer through a different application Should work seamlessly in CSTS Do not send test files/images/etc. Do not run the data earlier than we request. 15 Stakeholders Don’t wait!
Start in Probation – discussed implementation with line staff, including support staff Reaching out to Judges – at COJAC and in smaller settings Get to Prosecutors – needed them on board to have success getting charging information 6/19/2019

16 In House – Support Staff
Had to figure out who needed what information and when In order to use the MNPAT, we needed all clients open in CSTS that needed bail studies completed. Support were added to the “All Probation Bail Group”. Jail staff over bail study requests, which is cross-referenced with the transport list and our in-house bail study list. Support staff review the requests and lists in the morning, run NCIC, and open clients and assign them to the agent completing bails on that day. *What about a “dummy agent”? 6/19/2019

17 In House – Probation Agent
Agents wanted to start quickly after training Went live before the initially planned “go live” date. Had an informal meeting to discuss logistics with staff before implementation. Agents are responsible for their assigned day. Went live with the CSTS template version of MNPAT(pre-module) Sought consistency in an inconsistent world. Standard conditions of release were not being used 6/19/2019

18 Out House - Prosecution
Had to get the buy in from the County Attorney’s office to get charging information Met with attorneys and legal assistants Had them send charging information to the “All Probation Bail Group” distribution list Did it work right away? Agents were asked to notify supervisors in cases where charging information was not sent to Probation Agent have been watching MNCIS for charging information in situations where s seem to be lacking 6/19/2019

19 MNPAT module Some items were already in place
Support staff were already opening clients/cases in CSTS Jail and Prosecution were already using the “All Probation Bail Group” list Some items were not in place (validation study compliance) We were not waiting for the MNCIS file number before finalizing the MNPAT. We had to change again. Agents create it and send it via to bail distribution list. Agents then put the questionnaire and any other documents in the support staff mailbox. Support staff - Before closing the case, get MNCIS Add File # to MNPAT Finalize the MNPAT Close case 6/19/2019
