21 PRESENTATION

22 GDPR Due to come into force on 25 May 2018
Replaces the existing 1998 Data Protection Act In essence all businesses will be caught by the GDPR New concepts as well as enhanced protection for data subjects

23 Phrases you may have heard
Data Protection Officer Accountability Consent and lawful basis Subject Access Requests Significant Fines Privacy Impact Assessment

24 A few tips…. Educate senior management
Allocate time, responsibility & money to Data Protection Data Audit - Identify what information you hold Review the basis under which you hold/ process data Review & Update data protection policies & employee training Review privacy notices Review data security & ensure you have a data breach procedure Review data sharing agreements/ clauses for compliance

25 GDPR and franchising…. Individual franchisees (and/or their employees) should be treated like any other individual you hold data about E.g. provide privacy notice, info on rights etc Franchise agreement / manual / website? Customer data is a far harder nut to crack Franchisors consider that data about franchisees’ customers belongs to the franchisor… But is this borne out in practice? Also consider franchisee leads

26 GDPR and customers…. Franchise agreements generally state that customer data belongs to franchisor - But who is doing the processing? And for whom? Franchisor, franchisee or joint / common controllers? Why does it matter? Data processing contract requirements / Responsibility for your processors Marketing! Marketing to customers Generally customer has contract with franchisee Make clear in privacy notices given to customers if franchisor is to have right to market to them – name them Customers can object to marketing in any event & request deletion No one size fits all – new and existing customers may be different

27 GDPR and employees Employers process significant amounts of employees’ personal data All employers will be affected, irrespective of number of employees Ability to rely on consent (historically used by employers) greatly reduced Obligation to inform employees if there is a security breach of their personal data

28 Employers GDPR To Do List
Carry out HR Data Audit Send all existing staff amendments to contract Prepare updated contracts for starters post-25 May Prepare privacy notices for employees, applicants and leavers Review and update Handbook and policies (inc sickness, disciplinary, DBS checks etc) Consider need for DPIAs Draft Appropriate Policy Documents, if necessary Train staff and managers on GDPR
