2 Transposition of Directive 89 / 336 EEC in Romania Directive 89 / 336 EEC = Government Decision 1032 / October 2001

3 The lists of the harmonized standards under the Electromagnetic Compatibility Directive published in the Official Journal was transposed through the order 409 / 2001 and order 555 / 2001, common orders submitted by the Minister of Communication and Information Technology together with the Minister of Industry and Resources. 4 Competent authorities in the field of electromagnetic compatibility in Romania: Ministry of Communications and Information Technology – for mobile radio equipment and commercial telephonic radio equipment, information technology devices, networks and telecommunication equipment; Ministry of Industry and Resources – for equipment for industrial manufacture.

5 The designation of the bodies in the field of electromagnetic compatibility The designation of the bodies in the field of electromagnetic compatibility is made by Ministry of Communication and Information Technology with the purpose of evaluation of the conformity with the main requirements of the IT equipment protection.

7 When transposing the Electromagnetic Compatibility Directive in the Government Decision 1032 / 2001 European Commission made several objections regarding : 1. A clearer definition of certain terms as well as terms whose definition was not included in Government Decision 1032 / 2001; 2. The modification of the evaluation of the conformity carried out by the designated bodies; - elimination of CS marking (national marking of conformity) - modification of the evaluation procedure was made according to the conformity with the standards.

8 3. Reducing the number of authorities responsible with market surveillance and clearly establishing their fields; 4. Reducing the number of documents that certify the conformity (this is carried out by the Declaration of Conformity issued by the producer of his authorized representative)

9 Government Decision was amended and approved in its new version by the Romanian Government. At present Government Decision is the precise transposition of the Directive 89 / 336 EEC.
