Regulation (EU) No 540/2014: commonalities and differences with UN R138.00

2. Application time plan of EU legislation
The AVAS provisions described in Annex VIII, Section II to Reg. (EU) No 540/2014 (“1st set”) shall apply:
a) in any vehicle type approved before 1 July 2019;
b) in any new vehicle based on the type referred to above, before 1 July 2021.
The AVAS provisions described in Annex VIII, Section III to Reg. (EU) No 540/2014(“2nd set”) shall apply - UN R aligned
a) in any vehicle type approved before 1 July 2019, where the manufacturer so chooses;
b) in any new vehicle based on the type referred to in the above point a);
c) in any vehicle type approved on or after 1 July 2019;
d) in any new vehicle based on the type referred to in the above point c);
e) in any new vehicle on or after 1 July 2021.

Commonalities between EU legislation and UN R before 1 July 2019 (“1st set”):
Same vehicle categories addressed
AVAS functioning: in forward motion (same speed range < 20km/h) and in reverse motion
AVAS not necessary in reverse motion when audible warning exists – in UN R not necessary if reverse motion sound > 50 dB(A)
Commonalities between EU legislation and UN R from 1 July 2019 (“2nd set”):
a) Tests
b) Frequency & frequency shift
c) Min sound level
d) Exemptions from AVAS equipment

4. Differences between EU legislation and UN R138.00
Differences between EU legislation and UN R before 1 July 2019 (“1st set”):
a) pause function (mandatory in EU legislation, optional in UN R138.00)
b) Tests: not AVAS specific in EU legislation, in accordance with the sound emission tests in Reg. (EU) No 540/2014, for the max sound emission level measurement
c) No min AVAS sound level
d) AVAS sound frequency or shift through sound type description (no precise values)
e) Voluntary application of UN R requirements during the “1st set” application period

Differences between EU legislation and UN R from 1 July 2019 (“2nd set”):
a) Sound type (not determined in UN R138)
b) Sound max volume (M1 vehicle in Reg. 540/2014, 75 dB(A) in UN R138)
c) Attenuation
