6 Principles of Utmost Good Faith
A contract is a legally binding agreement that requires three elements: Offer Acceptance Consideration What is Caveat emptor ??? Why would this be considered to be unfair in an insurance contract ???

What is Uberrima Fides ? “A positive duty to voluntarily disclose, accurately and fully all the facts material to the risk being proposed, whether material or not” Who does this apply to? Insured only Insurer only Both insured and Insurer

22 Duration of the Duty of Disclosure Policy Condition Rules
Common Law Rules There is a need for the customer to be honest during the negotiation stage, at any mid term adjustments and again at the renewal stage. Policy Condition Rules Insurers write a condition into the policy which means the customer must now advise the insurer of any material changes. This is referred to as the continuing requirement.

24 Consequences of Non Disclosure
Consumers – CIDRA 2012: If the consumer took reasonable care not to breach their duty or If the breach did not induce the insurer to take on the risk, they have no remedy. If the above is not the case, then the breach is classed as “qualifying” and the insurer has two remedies: If deliberate or reckless they can void the policy If it was careless the insurer has two options: Alter their terms and deal with the risk as though there was no breach OR Proportionately reduce the amount paid, if they would have charged a higher premium.

25 Consequences of Non Disclosure
Commercial customers – Insurance Act 2015: If the insured is in breach of the duty of disclosure, the insurer may avoid the policy ab-initio For both commercial and consumers If non-disclosure or misrepresentation is fraudulent then: The policy is voidable. The insurer can keep the premium and sue for damages. They can however ignore the breach of good faith, in which case the policy continues and the claim must be paid.
