Two laws that are important here:
CHILDREN’S COURT Procedures Operation Two laws that are important here: - Children’s Court Act 1987 (NSW) - Children (Criminal Proceedings) Act (NSW) (deals with sentencing) What makes it unique? - Deals with juveniles years old (the crime must have been committed when under 18, but the person can still be put through the Children’s Court if they’re under 21 when charged with the crime) - It’s a closed court (no public; media can be there, but cannot reveal any identities - Summary jurisdiction (it’s at the same level as a Local Court, but it’s incredibly important). It deals with all but the most serious crimes committed by young people (as we saw in the Corey Davis case, it was heard in the Supreme Court eventually). - The court is more able to be flexible and aim for rehabilitation (rather than retribution – remember the purposes of punishment?) - It also deals with issues to deal with the care of children (separately to the criminal cases) - The court procedures are less formal and the young person is more able to participate and ask questions in order to understand what is going on
