1 OFFICE OF ADVOCACY Created by Congress in 1976.
Representing small business before Congress, the White House, and the federal agencies. Works with federal agencies to find alternatives to proposed rules that are disproportionately burdensome to small business. Mandated by Congress to research topics important to small business. Chief Counsel leads the independent office.

2 INDEPENDENT OFFICE Located in D.C. with 10 Regional Advocates across the country. From the Chief Counsel to the public, comments are not vetted by: The White House Congress, or The SBA.

3 OFFICE OF ADVOCACY We are the independent voice of small business within the Federal Government.

5 REGULATORY FLEXIBILITY
“Most small businesses do not have the time to constantly check the Federal Register for proposed federal rules, so our job is to monitor that process for them.” — Chief Counsel DePriest Works on behalf of small business in the federal regulatory process Find reasonable alternatives to proposed rules with a disproportionate impact on small business. In FY2016, Saved $1.4 B in regulatory costs Filed 20 comment letters with federal agencies. Hosted 27 small business roundtables Participated in seven SBREFA panels

7 REGULATORY REFORM Regulatory costs easily rival revenues from individual income taxes and corporate taxes combined.

8 REGULATORY REFORM If regulatory costs were a country it would be the world’s 7th largest economy

9 REGULATORY REFORM The Small Business Regulatory Enforcement Fairness Act. Government agencies must consider the effects of their regulatory actions on small entities Agencies were required by the RFA to certify that there would not be a significant economic impact on a substantial number of small entities

10 REGULATORY REFORM Small Business Regulatory Enforcement Fairness Act of (SBREFA) Formal procedure for the EPA and OSHA to solicit direct input from small entities on the effects of their proposals prior to the beginning of the normal notice and comment periods for these rules. Judicial review based on RFA compliance.

11 REGULATORY REFORM Executive Order 13272
Notify Advocacy of any draft rules that may have a significant economic impact on a substantial number of small entities Give every appropriate consideration to any comments provided by Advocacy regarding a draft rule Must provide in its explanation or discussion accompanying publication of a final rule its response to any written comments from Advocacy

12 REGULATORY REFORM Advocacy is involved in Regulatory Reform efforts underway as a result of two recent regulatory Executive Orders: Executive Order Reducing Regulation and Controlling Regulatory Costs for every one new regulation issued, at least two prior regulations be identified for elimination. the total incremental cost of all new regulations, including repealed regulations, to be finalized this year shall be no greater than zero Executive Order Enforcing the Regulatory Reform Agenda Each agency shall establish a Regulatory Reform Task Force evaluate existing regulations and make recommendations to the agency head regarding their repeal, replacement, or modification

13 REGULATORY REFORM Fiscal Year 2017: In the first eight months of the administration, agencies have far exceeded the two-for-one and regulatory cap requirements. 22-to-1: Agencies issued 67 deregulatory actions and only 3 regulatory actions. Saved $8.1 billion: Agencies saved $8.1 billion in regulatory costs, or $570.4 million per year.

14 REGULATORY REFORM Better than 2:1 - Agencies plan to finalize three deregulatory actions for every new regulatory action in FY2018. 1579 Withdrawn or Delayed Actions - Agencies continue to eliminate, delay, or streamline regulatory actions in the pipeline. In this Administration, agencies withdrew or delayed planned regulatory actions, reflecting all such changes from Fall 2016 to Fall 2017. 635 regulations were withdrawn from the Unified Agenda (469 in the Spring 2017 Update to Agenda; 166 in the Fall 2017 Agenda) 244 regulations were made inactive (166 in the Spring 2017 Update to Agenda; 78 in the Fall 2017 Agenda) 700 regulations were added to the Long Term list (401 in the Spring Update to Agenda; 299 in the Fall 2017 Agenda)
