3. Duty of Care
You now have a ‘Duty of Care’ to ensure the safe and proper disposal or recovery of whatever waste you produce.

Comply with European Hazardous Waste Directive 91/689/EEC (HWD)
Ensure safe management of hazardous waste
Identify where the waste is produced
Provide cradle-to-grave documentation of movement of the waste
Set tighter limits on hazardous waste going to landfill (WAC)

15. Exempt Premises
To be exempt from registering the premises the following criteria must be met
The amount of waste removed must not exceed 200Kg in total over 12 months
The waste must be removed by registered carrier

17. Fly Tipping
One very important exemption is Hazardous Waste that has been Fly-Tipped.
Regulation 22(2) provides that where waste has been deposited in contravention of The Environmental Protection Act 1990 it may be removed without requiring registration of those premises. (consignment notes must still be used in the normal manner)
