Who makes the decision and who signs what?

2 Signature delegation Why is signature delegation important?
Who delegates? What does the OSP Director have delegated authority to sign? All incoming sponsored funding agreements, amendments and prior approvals, out-going subawards/subcontracts, master agreements, memoradum of understanding, equipment loan agreements, certifications (related to sponsored funding), service center agreements, fee-for-services agreements, student educational activity agreements (sponsored funding).

3 What about NDAs and MTAs?
The Director of Technology Transfer, Jeremy Tamsen, has delegated authority to sign non-disclosure and material transfer agreements that do not include monetary exchanges.

4 What about services agreements?
Purchasing Services has the authority to sign out-going services agreements (not subawards or subcontracts), including services agreements from sponsored funding. When the services agreement is issued from sponsored funding, the OSP Cost Accounting unit has to approve prior to issuance.

5 How are types of agreements distinguished?
When there is a question of what type of funding mechanism we are receiving (gift or grant/contract/cooperative agreement) or what type of agreement we are going to issue (subaward/subcontract or vendor services agreement), OSP uses the federal definitions in the chart on the next page, and APMs and 45.15, and the gift vs. grant determination checklist. Fee-for-services: We are also developing a fee-for-services policy for services purchased from the university (such as DNA analysis) in a non-approved services center. This policy will outline the differences between a sponsored project, gift, and fee-for-services (or services center) project. OSP is a final authority (delegated by VPRED) with collaboration of and in agreement with the partner unit (e.g. the Foundation, Purchasing) in making the decision on type of funding mechanism. 7 Examples Faculty A is asked to submit a cost estimate to a state fish and game department, for diet analysis of 80 samples of owl pellets, so that the F&G unit can determine primary food source in a specific location. 8 Examples Faculty B is notified that a state entity plans to award $50,000 to his/her department to be used for research on ostrich population decline, in exchange for a report each year on research progress, outcomes, and financial expenditures. What is the most likely classification if agreement is to be received? A: Gift. B: Contract. C: Fee-for-services. D: Grant.

9 Examples Faculty C is notified that an entity plans to award $20,000 to his/her department to support growing a research program focused on decreasing pesticide use on crops. What is the most likely classification if agreement is to be received? A: Gift. B: Contract. C: Fee-for-services. D: Grant.

10 Examples Faculty D received a grant from the National Science Foundation to study chocolate textures. A university partner has a lab that can produce different varieties of chocolate at a bulk reduced price. What is the most likely out-going funding mechanism? A: Gift. B: Services Agreement. C: Subaward. D: Contract.
