2 Legal liability in a personal injury accident is determined by the general rule of carelessness and the following propositions:

3 If the injured person was at a place where he or she should not have been at the time of the accident, the person who caused the accident may not be liable because they had no duty to protect the safety of that person.

4 If the person suffered injuries because of his or her own carelessness, their compensation may be reduced by the extent of their carelessness under the comparative negligence theory.

5 If the accident occurred on a property that was poorly maintained and dangerous, the property owner will be held liable regardless of whether or not the property owner created the dangerous condition. If the accident was caused by a defective product, the manufacturer and seller of the product would both be liable.

6 If the accident was due to the negligence of one of more parties, all the negligent parties are liable for the injuries.
