1 REPUBLIC OF THE MARSHALL ISLANDS (RMI) MARITIME LABOUR CONVENTION, 2006 (MLC, 2006) ISSUES

2 WHO WE ARE International Registries, Inc. and its affiliates (IRI) provide administrative and technical support to the RMI Maritime and Corporate Registries. IRI provides a broad spectrum of services for the shipping and financial services industries. The RMI Registry is considered an “open registry.” IRI is aiming to maintain a good standard for the RMI and ranking within the international shipping world.

All complaints (communications) thus far have been received via: (90%) Inspector on scene (5%) Phone call or letter (5%) Initial assessment of claim is done by the department head for MLC, with assistance from: Seafarers, Inspections, Investigations, Legal, and/or Regulatory Department(s) as appropriate If the complaint is deemed valid, an action-team is put together to handle the issue Subsequent investigation is done by the local IRI office / representative

International Transport Workers’ Federation (ITF) involvement ranges from full cooperation to non-existent Case is typically closed out when the local inspecting office and the responsible person for MLC, 2006 grievances are satisfied Cases are recorded: MLC, 2006 Crew Grievance Statusboard (this is the official record which is used to report to the International Labour Organization (ILO)) All correspondence is retained with each case

9 LESSONS LEARNED The majority of claims involve non-payment of wages
It is often a very difficult and timely process to have the owners / operators make the (crew wage) payments Many seafarers are aware of MLC, 2006, but not: The on board complaint procedures The existence of the Designated Person Ashore (DPA)

10 AMENDMENTS TO MLC, 2006 ON FINANCIAL SECURITY
New amendments came into force on 18 January 2017 Standard A2.5.2 – Financial Security Requires financial security system in place to cover abandonment Standard A4.2.1 – Shipowner’s Liability Assures compensation in the event of a contractual claim Standard A4.2.2 – Treatment of Contractual Claims Defines “contractual claim” as any claim that relates to death or long- term disability due to an occupational injury, illness, or hazard set out in national law, Seafarer’s Employment Agreement (SEA), or Collective Bargaining Agreement (CBA) *Ships have to carry a certificate or other documentary evidence of financial security on board, as issued by the financial security provider.
